    Jacob Rohrer's Last Will & Testament

    In the name of the Benevolent Father of all, I Jacob Rohrer of the Jefferson Township Montgomery County and of State of Ohio.. do make and publish this my last will and testament

    "*em First" I give and devise to my beloved wife in lieu of her dower the farm on which we now reside situate in the County of Montgomery & state of Ohio being the Southwest quarter of section number fifteen township three range five during her natural life or so long as she survives me. I also bequeath to my said wife a certain bey horse bald face and also I give and bequeath to my all the beds and bedding belonging to me. I do hereby appoint my beloved wife and my esteemed friend Daniel Noftsinger Sen of Jefferson Township Montgomery County; my executors of this my last will and testament hereby authorizing them to compromise adjust release and discharge in such a manner as they may deem proper the debts and claims due me. And whenever thought advisedly by my said executors and my heirs to sell the said farm where we now reside the are at liberty to do then and in that case my said wife to receive annually the interest of One Thousand dollars during her natural life or so long as she remains my widow. And whereas I have paid to each of my sons as they arrived of lawful age three hundred dollars and each of my daughters Two hundred dollars. And those now under age to have the same when they become of lawful age. IE Boys Three Hundred dollars and the girls Two hundred dollars; and afterwards my said heirs to receive equally shares of my estate; And I also appoint my said executors as guardian for my son Samuel and my daughter Barbara and son David and Elijah and lastly at my decease my executors to sell at public vendue all the stalk and property that may not belong to my said wife. And I also authorize and impower my said executors to convey said farm by deed & in testimony whereof I have hereunto set my hand seal this fifth day of June in the year of lord One Thousand eight hundred and forty five 1845 his Jacob x Rohrer (ss) signed and mark acknowledged by said Jacob Rohrer as his last Will and Testament in our presence and signed by us in his presence.     The State of Ohio Montgomery County.

    Be it remembered that at a Special Term of the said Court of Common Pleas held at the clerks office in the city of Dayton it appearing to the court that Abraham Runche one of the subscribing witnesses to said Will is a resident of Wayne County Indiana. It is ordered that a commission issue to John Burnett Esquire of Montgomery County Ohio to take the deposition of said Abraham Runche in said Wayne County in the matter of the probate of said will and file said deposition in court before the next term thereof. And afterwards to wit on the said thirty first day of January Anno Domine Eighteen Hundred and forty eight there was issued out of said clerks office the following writ of Dedinins Protestatum directed to John Burnett in the words and figures following to wit. "The State of Ohio Montgomery County "R."
    "Court of Common Pleas Special Term January 31st AD 1848

    To John Burnett Esq of said Montgomery County and State "Greetings". Know ye that in confidence of your prudence and fidelity the Court of Common Pleas within and for the said County of Montgomery have appointed you and by these present do give to you full power and authority to examine and take the deposition of Abraham Runche of Wayne County in the State of Indiana in a certain matter pertaining to the probate of the last Will and Testament of Jacob Rohrer said Montgomery County deceased pending in our said Court of Common Pleas within and for said Montgomery County; you are therefore commanded to proceed at and on a day or days certain and a place by you to be appointed to take the depositon of the said Jacob Runche having first duly notified him of such time and Place and him examine on his corporal oath touching the execution proof and acknowledgement of the said last Will And Testament as aforesaid and that such examination you reduce to writing in the form of a deposition and return the same together with this writ closed up under your seal to this are said court with all Convenient speed

    And afterwards to wit in the Twelfth day of February Anno Domini Eighteen Hundred and Forty eight the said John Burnett returned to said Clerks office and filed therein said writ issued to him as aforesaid with the endorsement thereon to wit " In obediance the Command of said dedimus I have ta him the deposition of the said Abraham Runche which is hereto attached. February Twelfth AD 1848 John Burnett special commissioner " Attached to said writ is the examination to the said Abraham Runche in the words and figures following "to wit"

    Personally appeared before me John Burnett special commissioner for that purpose. Abraham Runche residing near Abbington Wayne County in the State of Indiana at the house of the said A Runche, who being duly sworn depose and say that the paper before him purporting to be the last Will and Testament of Jacob Rohrer of Montgomery Count now deceased was by the said Jacob Rohrer acknowledged published and declared to be his last Will and Testament in the presence of this deponent that the said deceased was of lawful age that he was of sound and disposing mind and memory and under no restraint as he verily believes, that he subscribe the same as witness in the presence and at the request of the Testator and in the presence of John Burnett. Sworn to and ... scribed before me at the house of said Runche this seventh day of February 1848

    Personally appeared in open court John Burnett who being duly sworn deposes and says that the paper before him purporting to be the last Will and Testament of Jacob Rohrer now deceased was by said Jacob Rohrer acknowledge published and declared to be his last Will and Testament in the presence of this deponent, That the said deceased was of lawful age that he was of sound and disposing mind and memory and under no restraint as he verily believes. that he subscribed he same as witness in the presence and at the request of the testator and in the presence of Abraham Runche the other witness, sworn to and subscribed in open Court this 12th day of February AD 1848.

    And afterwards to wit At a special session of the Court of Common Pleas within and for the County of Montgomery and State of Ohio held at the clerks office in the City of Dayton on the 12th day of February AD 1848 "present Charles G Swain, Amos Irvin and Michael Cassady Esgrs Associate Judge of said Court and W.J McKinney clerk, the said last Will and Testament of Jacob Rohrer late of Montgomery County this deceased was this day brought before the Court and filed and John Burnett who was appointed by the court on the 31st day of January AD 1848 to take the deposition of Abraham Runche one of the subscribing witnesses to said Will having made return of his said co** mission with the written deposition of said witness to said will, being examined in court and ... examination reduced to writing and it appearing to the satisfaction of the Court that the said Jacob Rohrer at the time of executing said Will and the said Proof so reduced to writing be recorded. And therefore open motion of Mary Rohrer and Daniel Noftsinger the executors named in said will. It is ordered that letters Testamentary be granted to the said Mary Rohrer and Daniel Noftinger who were thereufrou duly affirmed and gave loud with George ****** and John Stouffer their security to the acceptancy of the Court in the penal sum of Ni** Thousand dollars conditioned according to law, on motion the Court appoint John Burnett Eli Noftsinger and Jacob Keen as appraisers of the Personal estate of said deceased. The said Mary Rohrer in open court elects under said Will to abide thereby

    To all to whom these presents shall come "*****" Whereas Jacob Rohrer late of said county aforesaid did by his last Will and Testament ordain constitute and appoint Mary Rhorer and Daniel Noftsinger executors of the same. And whereas at a special session of the Court of Common Pleas holden at Dayton in the County of Montgomery, aforesaid on the Twelfth day of February AD 1848 before Charles G Swain. Amos **** and Michael Cassady esquires associate judges in and for said county the said Last Will and Testament was exhibited and duly proven and the executors therein named as aforesaid having signified their willingness to accept the trust reposed in them by said testator. Therefore being that by the said Court of Common Pleas administration of all and singular the estate of said Jacob Rhorer deceased is hereby granted and committed to the said Mary Rhorer and Daniel Noftsinger Executors as aforesaid to be administered by them according to law and agreeable to the tenor of the said Last will and testament. Provided however it shall be the duty of the executors aforesaid to have all and singular the estate of the said Jacob Rhorer, deceased not otherwise disposed of by the said last Will and Testament inventoried and appraised by John Burson Eli Noftsinger and Jacob Keen householders of the County aforesaid under oath or afferniate And said inventory and appraisement together with an accurate statement of the debts due owing to the estate of said deceased to return to the clerk of the Court of Common Pleas of the County aforesaid within Three months from the date hereof, And further to settle up the estate so for as the provisions of the said last Will and Testament will admit within Eighteen months from the date hereof and a true and accurate statement thereof to make and return to the Court of Common Pleas as the Law directs..
