...Will of Capt. Henry John Macatee
    Born: 13 Aug 1769
    Died: 1 Sept 1852

In the Name of God Amen---
I, Henry Macatee, being weak in body but of Sound and Disposing mind and being desirous to settle my worldly affairs do make this my last Will and Testament in manner and form as follows:

In the first place. It is my will and desire that my Negro woman, Milly, at my decease shall have her choice to live with whichever one of my children she may choose and not liking her first choice she shall have the privilege of making another choice until she is satisfied, furthermore it is my will and desire on account of the faithful services of my said slave, Milly, that with whichsoever of my children she may finally reside with, she shall be treated with kindness and not oppressed in any manner and taken good care of in her old age not having served the one she may remain with all the time, those she may have served shall contribute to her support when she shall have gotten too old to work.

Secondly. It is my will and desire that the Executors as early as practicable after my decease shall pay to each of my grandchildren named Henry after me their parents or guardians for their use the sum of one hundred dollars each out of the proceeds of my Estate.

Thirdly. It is my will and desire that Notes, Accounts, &c, owed to me by my children shall not be charged with interest until the day of my death. The notes, accounts, &c, so owed to me at my death shall be received by those so indebted as part of their proportion of my Estate unless where anyone shall owe more than his proportion, then he shall pay the overplus to my Executors to be disposed of as hereafter directed. Whereas I have heretofore put my son, Clement, in possession of the Farm on which he resides on which I have expended a large amount of money in repairs and Buildings and is also unencumbered with any legacies. It is my will and desire that he should have no more of my Estate unless it may be what he owes me on Notes and Accounts out of which he shall receipt to my Executors for one hundred dollars for his son Henry us portion, the balance shall be his.

Fourthly. It is my will and desire that whenever the Archbishop of Baltimore shall determine to have a church built on the lot of ground laid off by me for that purpose and surveyed for one acre the said lot being on the southeast corner of what is called Richardson us Cross Road being part of the same tract heretofore deeded by me to my son, Clement. My Executors shall make a deed to the said Archbishop or his successor for the use of the church. It is my wish and desire that the neighbors wishing to build a schoolhouse on said lot shall have the privilege to do so on one corner of said lot so as not to interfere with the site for a church. I further enjoin it on my Executors that they take care of the wood on said lot and see that it be not cut down and destroyed while under their care.

Fifthly. It is my Will and desire that my Executors shall sell any lands I may die possessed of and deed the same to the purchaser except such as I may have stated in this will and collect all claims due me and after paying my just debts shall divide the same equally among my five children, Ignatius G. Macatee, George I. Macatee, Sylvester Macatee, Mary A. Raphel, Elizabeth A. Richardson, their heirs and assigns, share and share alike.

Sixthly. It is my Will and desire that my dearly beloved Brother, Francis Macatee, shall have my wearing apparel. Any one of my children dissenting this my Last Will and Testament shall be cut off from any benefit of my property. Should unhappily any dispute occur among my children in the settlement of my Estate it is my desire that they should not go to law but choose two disinterested persons to settle the difference and they not being able shall choose a third person. Furthermore, any other property which I may die possessed of not mentioned shall be distributed by my Executors as above stated.

And lastly, I do hereby constitute and appoint my son, George I. Macatee, and Henry Richardson to be Executors of this my last Will and Testament revoking all former Wills by me made ratifying and confirming this as my last Will and Testament.

In testimony whereof I have hereunto set my hand and seal this Eighth day of March in the year of Our Lord Eighteen hundred and forty-eight.
    (S) Henry Macatee

    Codicil to the above Will:
Whereas it is my wish and desire to satisfy my negro Woman, Milly, she having made choice of my daughter, Mary Ann Raphel, I do therefore will and bequeath her, the said slave, Milly, to my said daughter, Mary, enjoining it upon her that she shall never be sold or taken out of the state but shall remain in servitude in this state. I further enjoin it on my said daughter, Mary, that she take good care of her and treat her with kindness, revoking the clause in regard to my said slave, Milly, in my Will as above stated, ratifying and confirming this instead and also ratifying and confirming all the other parts of above Will as written.
