At a session of the Probate Court for the County of Berrien, holden at the Probate Office, in the village of Berrien Sprints, on Monday the 9th day of August in the year one thousand eight hundred and seventy-five [1875]
Present Daniel Chapman Judge of Probate,
In the Matter of the Estate of Hannah Smith deceased. On reading and filing the petition, duly verified, of Alfred Smith praying this court to adjudicate and determine what are or were the heirs of said deceased and entitled by the laws of Michigan to inherit the Real Estate of said deceased.
Thereupon it is ordered, that Tuesday, the 7th day of September next at 11 o’clock in the forenoon, be assigned for the hearing of said petition, ant that the heirs at law of said deceased, ad all other persons interested in said estate, are required to appear at a session of said Court, then to be holden a the Probate Office, in the village of Berrien Springs, and show cause, if any there be, why the prayer of the petitioner should not be granted; and it is further ordered, that said petitioner gibve notice to the persons interested in said estate, of the pendency of said petition, and the hearing thereof by causing a copy of this order to be published in the St. Joseph ____ & Herald a newspaper printed and circulated in the County of Berrien for three successive weeks, previous to said day of hearing.

At a session of the Probate Court for said County, held at the Probate Office in the village of Berrien Sprints on Tuesday the 7th day of September A. D. 1875.
Present, Daniel Chapman Judge of Probate, in the matter of the estate of Hannah Smith late of Hagar in said County, deceased.
This being the time and place assigned by this court for hearing the petition of Alfred Smith praying this court to adjudicate and determine who are or were the lawful heirs of Hannah Smith wife of Jeremiah Smith. And it appearing to the satisfaction of the court by due proof on file that due and legal notice has been given of the pendeney[?] of said petition and the hearing thereon. And it appearing by the evidence and proof now presented to the court that the Hannah Smith mentioned and referred to in said petition did intestate in Hagar aforesaid in the month of December A.D. 1858, leaving as her sole and only heir Henry Smith, Abram Smith, Michael Smith, Wesley Smith, Sophia Smith afterwards, by marriage, Sophia Rosa

Wherefore it is considered, adjudged and determined by this court that the said Hannah died in said county of Berrien int he Month of December A. D. 1858, leaving at her death her surviving as heirs and her only heir Henry Smith, Abram Smith, Michael Smith, Wesley Smith, Sophia Smith afterwards, by marriage, Sophia Rosa, Jannette Smith afterwards, by marriage, Janett Rosa. Ruth Ann Smith afterwards by marriage Ruth Ann Clapside and Alfred Smith. And that said Henry Smith, Abram Smith, Michael Smith, Wesley Smith, Sophia Rosa, Janette Rosa, Ruth Ann Clapside and Alfred Smith are entitled by the laws of the State of Michigan to inherit the Real Estate of which the said Hannah Smith died seized and possessed.
In testimony whereof I have hereunto set my hand and affixed the Seal of the Probate Court This 7th day of September A. D. 1875.

In the Matter to determine who are the legal heirs of Hannah Smith, deceassed on the petition of Alfred Smith.
To the Probate Court for the County of Berrien.
The petition of Alfred Smith of the township of Hagar in the County of Berrien and State of Michigan respectfully shows to this honorable court that Hannah Smith, wife of Jeremiah Smith, departed this life on or about the twenty-fifth day of December A.D. 1858, and that at the time of her demise as aforesaid she was a resident of said township of Hagar in said County of Berrien.
Your petitioner further shows that said Hannah Smith died seized in fee simple of certain lands situate in said County of Berrien described as follows:
The north west quarter of the north west quarter of section twenty-five, in town three south, of range eighteen west, containing forty acres of land.
Image 15- Your petitioner further shows that the heirs of the said Hannah Smith at the time of her demise as aforesaid so far as the same is known to your petitioner, and as yours[sic] petitioner believes and charges the truth to be, were Henry Smith, Michael Smith, Abram Smith, Sophia M. Rosa (nee Smith), Ruth Ann Smith, Janett Rosa (nee Smith), Wesley Smith, and your petitioner Alfred Smith, then residents of said Berrien County.
Your Petitioner further shows that he claims an interest in said lands herein particularly described as owner thereof in fee simple, and that his dais interest in and title to said lands, was derived through and under said heirs of Hannah Smith, herein particularly named, by deed executed and delivered by them and each and all of them to your petitioner, after the decease of said Hannah Smith, as aforesaid.
Your Petitioner therefore prays that this honorable court may determine and adjudicate who were and are the legal heir or heirs of said Hannah Smith, deceased and entitled by reason thereof
Image 16- and of the laws of the State of Michigan, to inherit the real estate and lands of which the said Hannah Smith died seized, and convey the same, and that such finding and adjudication may be entered on the journal of this honorable court.
And your petitioner further prays that this honorable court may upon the filing of this petition, make an order setting forth the time and place of hearing this said petition, and cause notice of this said petition and of the time and place assigned for the hearing thereof to be given in the manner provided by statute.
