George H. Gillespie Dec'd, [proven] 7th Sept. 1846, Mins. 20, pg. 273
In the name of God Amen!. I George H. Gillespie of the County of Greene and State of Tennessee, being advanced in years but of sound mind and memory, and knowing that it is appointed for all men once to die and being admonished by the disease under which I now labour, that I may shortly die, do make my last will and testament, as follows:
1st. I direct that my funeral expenses and all my just debts shall be first paid by my Executors hereafter named out of my Estate.
2nd. I give and bequeath to my beloved wife Ann Gillespie the dwelling house and all out [our] houses and buildings on the farm where I at present reside and all my household and kitchen furniture, and also the choice of the following stock (to wit) two cows and calves, eight head of Sheep, ten head of hogs and all the poultry on the farm also my two mares Rose and Sal, also a loom & table, one cotton wheel, one flax wheel, and if there should be more money arising from the property sold and debts owing to me at my decease than will be nessary [necesssary] to pay all my just debts, my said wife is to have the overplus, also she is to have two pair of plough geers [gears] and one plough all of which property and interest she is to have hold and enjoy during her natural life or widowhood.
3. I give and bequeath to my grandchildren, the children of my daughter Eliza Ann Bullen as well those how in existance as those that may hereafter be born of her body the following named Negroes, to wit, my boy Pleasant, Alexander & Anderson, and my girl Martha, which slaves it is my will shall remain in the persession [possession] of my said daughter Eliza Ann Bullen exclusively and their servises [services] to be appropriated to raising and educating my said grand children. The said Slaves and their increase shall remain in the persession [possession] of my said Daughter during her lifetime and at her death shall fall to her children as before state provided said slaves shall conduct themselves well but in case they become turbulent and my said daughter not wishing to keep them as before provided, the said slaves shall be sold at public sale for Cash in hand or on time as may appear best to be executors, and the purchase money shall be put out on Interest untill my said grand children shall become of lawful age, the interest of which shall be used by my said daughter in maintaining and schooling the said children.
4th I give and bequeath to my grand Children, the children of my daughter Barbara Jane Stonecifer as well those now in existence as those that may be hereafter born of her a Tract of land containing seventy acres and ten poles in Greene County conveyed to me by Loyd Bullen as trustee in a deed of trust made by Absalom Stonecifer Jr. to said Bullen for my benefit deed of trust dated on the 4th of May 1841 and the deed from Bullen to be was made on the 5th day of July 1844 and also the following named Slaves with their increase, to wit, Matilda, John, Jackson and Henry which Lands & Slaves, it is my will shall remain in the immediate persession [possession] of my daughter Barbara Jane Stonecifer and the proffits arising from the land and the servises of the said Slaves she shall have for the purpose of educating and maintaining, my said grand [children] exclusively and at the death of my said daughter the said property to go to my before mentioned grand Children, as it is my will that the said slaves should remain in the persession [possession] of my said daughter during her lifetime, but if the said slaves should not conduct themselves well and my said daughter should not wish to be encumbered with them, then as is provided for my other daughter, the said slaves shall be sold and the proceeds placed on Interest untill the said children become of lawful age, the interest to be applied ad used in the same manner as is provided for my other grand Children.
5th. It is my will that my two Slaves that I have now at home Anderson and Andrew, shall remain with my widow during her lifetime or Widowhood provided she wishes to keep them and they conduct themselves well and in case they become disobedient to her, at her request my Executors to sell or hire out said, two boys as she may wish, if sold she is to have the interest arising from the purchase Money or if hired out She is to have the hire, but the principle or Slaves as the Case may be is for my grand Children one half to the children of Eliza M. Bullen and one half to the children of Barbara Jane Stonecifer to be applied in the same manner as is provided in my former bequests them and I hereby desire and direct that my wife and two daughters shall support my old and faithful Negro woman Diner comfortably during her life I direct that she remain with them & that she be not sold.
7th [skipped 6th apparently]. It is my will that my Executors shall pay to the orphan girl who I have raised named Betsy Ann Beals Sixty dollars in Cash out of the money arising from the sale of my estate when she arrives at eighteen years of age or marries, also a good Cow & Calf, and that my wife give her at the same time one fether [feather] bed under bed & furniture all this however upon condition she remains with my wife and conducts herself well untill the time aforesaid.
8th. I further give and bequeath to the children of my daughter Barbara Jane Stonecifer all the property stock & c. that I purchased or that was surrendered to me my other purchasers at a sale made by Loyd Bullen as trustee of Absalom Stonecifer in the use of which property & Co. my daughter Barbara Jane Stonecifer shall have exclusive [use?] of all their persons to help her to maintain and educate her children with all its increase and such of it as may not be consumed in its using, at the death of my said daughter shall be given to her children, as heretofore provided for.
9th. It is my will at the death of my widow, that my Executors shall sell at public or private sale my home tract of land for cash down or on time as they may think best for my legatees and two hundred dollars of the purchas [purchase] money first be taken out to go to the children of my daughter Barbara Jane Stonecifer and the remainder to be divided one halve to the children of my daughter Eliza Ann Bullen and the other half to the children of my daughter Barbara Jane Stonecifer all of which money is to be used and applied as my other bequests to my grand Children the principle never to be used but to be paid over to my grand Children but the interest as before directed to be expended by my daughters in raising and educating their children.
Lastly I hereby nominate, constitute and appoint my two sons in Law and trusty friends Loyd Bullen and Absalom Stonecifer, Jr. sole Executors of this my last Will and testament, hereby revoking all former Wills, Legacies or bequests by me at anytime heretofore made or given.
