In the name of God Amen: 1 Edw'd Herndon of the County of Spotsylvania being in perfect mind and memory do constitute and appoint this my last Will and Testament as follows: that after my funeral expenses and just Debts be paid and fully satisfied, the rest of my Estate be disposed of as following:
Item. I give and bequeath all my Estate both real and personal to myLoving wife Mary Herndon, to her and her heirs and to be at her disposal for ever.
Item. My Will is and would be hereby understood that what I have already given to my Children Edward, John andJoseph and Elizabeth Battaley is all I intend for them of my estate etc.
Item. I do appoint my Loving Wife Mary Herndon; my Hon'd Friend George Waller and my Loving Son Edw'd Herndon Jun'r and my Loving Friend Geo. Waller, Junr whole and sole Ex'rs and Executors of this my last Will and Testament, revoking all other wills by me made, and do acknowledge this only my last Will and Testament; In witness whereof I here seal--publish and pronounce the same.
