Will of Ebenezer Titus

State of Missouri
County of Ray
In the name of God Amen, I Ebenezer Titus of the County and State above named being old and feeble in bodily health but of sound mind and disposing memory (Blessed be almighty God for the same) do make and do claim this as my last will and testimony In manner and form following viz
I bequeath my soul to God who gave it, blessed be his holy name
I will and devise that all my just debts, liabilites and funeral expenses be paid
I will and desire that my body be intered in a plain and decent maner, and laid by the side of my late departed wife
I will and bequeath my daughter Mary Odle sixty acres of land designated by numbers as follows twenty three acres of the west side of the north east quarter of the north west quarter twenty three acres off the west side of the south east fourth and ten acres off the east side of the north west fourth and four acres out of section seven north of the above described land all of section eighteen Township fifty two and Range twenty nine during her natural life also two notes absolutely that I hold against her I will and bequeath my daughter Elizabeth McCorkle during her natural life Thirty three acres of land m_______ the balance of the north west fourth not bequeathed to my Daughter, - Mary Odle
I will and bequeath to my Daughter Arthusa Furguson during her natural life all land lying east of the land bequeathed to my daughter Mary Odel supposed to be forty acres more or less if one of my Daughters dies I give all of the land during their natural lives to the surviving ones. If two of my Daughters dies I give all my land to the surviving one during her natural life
I give and bequeath to my two Daughters Elizabeth McCorkle and Arthusa Furguson all of my money goods and chattels and all evidence of debts due me not otherwise disposed of in this will. __posing special confidence and trust in my two grand sons namely Calvin C. Martin and Daniel W. Pettis to sell all my land within three months after ?...? (probably date of death) and pay themselves out of the proceeds for their trouble and divide the balance equally between my grand children and except Noah Titus and Squire Titus as a legacy withheld from them I give and bequeath to my grand son Rice Martin son Calvin C and minie Martin
I hereby forbid any appraisment or sale of any part of my estate except as directed in this will and testiments by made
In testimony whereof I set my hand and seal this 15th January AD one thousand (unreadable line in this copy)

Signed sealed, published and declared by the above named Ebenezer Titus to be his last will and testament in the presence of us, who have hereunto subscribed our names as witnesses in the presence of the testator

State of Missouri| In the Probate Court of Ray County Missouri, County of Ray | In vacation June 19. 1878.
I Charles J. Hughes Judge of the Probate Court of the County of Ray aforesaid and Exafficio clerk thereof Do Hereby Certify that I have examined the foregoing Instrument of writing purporting to be the last will and testament of Ebenezer Titus signed by him I having heard the evidence of Mark H. Wyman Wm Dillen(?) & A.J. Craven the subscribing witnesses thereto in relation to the same and that the said Ebenezer Titus deceased was of sound disposing mind and memory at the time of signing the same Do declare and Adjudge said instrument of ___ting aforesaid to be the last will and testament of him the said Ebenezer Titus deceased late of said County of Ray In testimony whereof I have hereunto set my hand & affixed the offical seal of the Probate Court of said Ray County Missouri at office in the city of Richmond in said Ray County this June 19th 1878.
