He married Sarah Ann James. Sarah was born in Prince William, Virginia about 1730. History of the Shumate by Robert S. Riley page 44 C. Daniel SHUMATE (II). He was born circa 1734 in Stafford County, Virginia, and died in February, 1806 in Fauquier County, Virginia. Von Stauffenberg wrote that Daniel (II) was the fourth son of John (II) and Judith Shumate. The writer disagrees and instead believes Daniell (II) was their third son, because von Stauffenberg again erred in aligning Richard Shumate--who he wrote was born in 1730 and who died at John Peyton's home on 2 Aug 1749--as a son of John (II) and Judith. On this page he plainly states, "We do not have proof that Richard was a son of Daniel SHUMATE (I) and he is discussed in more detail in Chapter 4. Returning to Daniel II the writer agrees that he probably married Sarah Ann JAMES (?) in Prince William County, Virginia circa 1754, primarily because there is no documentation to refute the same, and with the information about Sarah Ann Von Stauffenberg then proceeded to write on pages 57, 58, and 59 in The Shumate Family his rationale to distinguish Daniel II from the other Daniels of the day. The writer has selected some important excerpts of what he wrote on these pages, and they follow below: ..... Yet, from all the records available, there is singularly little trace of Daniel II in the crucial year of 1765-1782 -- at least none that we have found in Fauquier County. Tax List record him with his son Daniel from 1758 to 1762, and alone from 1762 to 1764. It is immediately wondered if, like his brothers before him he moved to another county. There is one possible explanation, as presented very dubiously by Mr. Benjamin Shoemaker in his transcript. ' . . . in 1772 a Daniel Shomack took out a land grant for 200 acres on Chavers Creek, a branch of the Savannah River in South Carolina. It is Daniel II who is the Revolutionary Veteran, despite man suppositions to the contrary. . . . Daniel II would have been about 42 to 47 years old in 1777 when he took oath as an Ensign in the Fauquier Militia in August. On Mar 1778, he was commissioned a second lieutenant in which capacity he served throughout the war, finally resigning in May 1781. . . . One Salient point should be noted: On the 1782 tax list which is alphabetically listed, two Daniel SHUMATE'S are listed - - one being styled Daniel Senior (Daniel I) whose son Daniel VI was born about that time; and the other simply until 1803, Daniel is consistently listed in possession of his same acreage in Fauquier, . . . . On occasion, his sons - - Daniel III, Donald or David are listed with him... It should be noted here that several of our informants have supplied a birthdate for the Daniel who served in the Revolution. It is for 14 June, 1749. In response to the above points made by von Stauffenberg, the writer proposes the following counter arguments. First, regarding the supposed tax lists from 1758 to 1764, any entries showing the Daniel Shumates would not have included Roman numerals to distinguish them one from the other. The writer is of the opinion von Stauffenberg ignored the obvious as was sugged to him by shumate family informants. He mentioned Daniel (II) had sons named Donald, David and Daniel III and that their names are listed along with his in the 1758-1764 tax lists. The writer submits that T.F. von Staufenberg confused Daniel II with Daniel (I) . Donald, David, and Daniel III were the son of Daniel I and his first wife, Elizabeth (Taliaferro), not Daniel II! Second, the Revolutionary War Veteran was Daniel Shumate III, who was born on 14 Jun 1749 and who died in Fauquier County, Virginia in October 1784 at age 35. A Copy of his Estate Inventory and Appraisement can be found on page C-55, Appendix C: Third, the Daniel Shomack, who took out the land grant in 1772 for 200 acres on Chavers Creek, a branch of the Savannah River in South Carolina, may have been Daniel Shumate (I) wo with his wife Mary sold the 100 acres inherited from his father to John (II), his brother, the year before. Subsequent to this land deed of 1771, no further documentary evidence, such as his will, other deeds, tax lists, etc. have been uncovered which can positively identify Daniel Shumate (I) as being a resident of a known county in which he may have lived. Instead, even though late in life, he and his wife may have migrated to South Carolina where they live and died. Or, they may have remained in Virginia after selling the land to John (II) and died there beofre the tax list of 1782. Fourth, T.F. von Stauffenberg erred in his analysis of the 1782 Personal Property Tax List of Fauquier County. There is no Daniel Senior on this list There is an entry for only a Daniel Shumate and an entry for a Daniel Shumate Junior (See page C-4. Appendix C.) Again von Stauffenberg confused the Daniels. The Daniel Shumate entry was Daniel (II) The Daniel Shumate, Junior was Daniel III, son of Daniel II. The names of Daniel (I), Donald, and Daivd do not appear in the Fauquier County Personal Property Tax Lists commencing in 1782. Beginning with the year 1785, one will note that the name of the widow of Daniel (III), Tabby (Tabitha Dodson), appears and continues in the lists through 1801. Although the writer's analysis may disappoint those descendents of Daniel Shumate (II) who would like to claim credit for service in the Revolutionary War for purposes of obtaining membership in the sons and daughters of the American Revolution, he believes the record must be set straight. Only the descendants of Daniel III are entitled to this honor based on the service of the man who was the ensign and lieutentant. Daniel Shumate II left his will in Fauquier County, Virginia dated 29 January 1806 (See compy on page C-59, Appendix C.) In his Will, Daniel identifies his wife Sarah Ann and his children William III, Mark I, Samuel III, Juda PARIS, Duanna JOHNSON, and Dinah LUTTRELL. He did not mention his son Daniel IV because the latter had lived in Monroe County--now West Virginia--for 26 years or more and had probably received his share of land or financial help from his father years before. As one can see in the Fauquier County land tax extracts (see pages C-16 C-17, Appendix C), Daniel II was not a large land owner. He is listed only as having 38 to 43 acres of land on which he was taxed. T.F.Von Stauffenberg erred again in reading Daniel II's will, because he did not notice the name of his son Mark. Instead he credited Mark (Hardin) SHUMATE I as being being a son of Daniel (I). Will Book 4 page 185-186 Fauquier County, Virginia. In the name of God, Amen. I, Daniel Shumate of Fauquier County of Leeds Parish being weak of body but of sound and disposing mind and memory, do make and ordain this my last will and testament in Manner and form following, that is to say, first I commend my Soul to God its creator in all humble hope of its futurehappiness through the only merits of my blessed Lord and Savior Jesus Christ, and my body to the ground to be decently buried at the discretion (SIC) of my executors hereafter named and as to worldly estate which God has been pleased to bless one with. I give and bequeath as followeth. Imprimis. I give and bequeath to my beloved wife Sarah Ann Shumate one feather bed and furniture, one Negro fellow name Jo and all the corn and provisions now in my possion (sic) for the support of the plantation this year to her and her heirs forever. It is also my Will and desire that the negro fellow belonging to John PARIS and the negro wench belong to my son William after my death shall remain on the plantation this year as my sons Mark and William promised me if I rented a plantation and began a crop they should do so. Item. The rest of my estate after the rent and my just debts are paid and one third part given to my wife are to be equally divided between my daughters Judah PARIS, DUANNA JOHNSON, Dinah LUTTRELL and my son Samuel SHUMATE but in case John PARIS takes his negro away his wife is to have not part of it and to be divided between the other three. Duannah died after May 16, 1829 in Fauquier, Virginia. She married Moses Johnson in Fauquier ?, Va, about 1776. Moses was born in Prince William, Virginia about 1740. He was the son of Jeffrey Johnson and Margret. Moses died about June 1803 in Leeds Parish, Fauquier, Va. (See Moses Johnson for the continuation of this line.)
