In the Name of God Amen I Christopher Hall of Maestrefgummer in the Parish of Trefeglwys in the County of Montgomery Gentleman being of sound disposing Mind and Memory Do make this my last Will and Testament in Manner following. Whereas by Articles of Agreement (made previous to my Marriage with Anne my wife and intended as provision for us and our Issue) bearing Date the Twenty Sixth day of March which was in the year of our Lord One Thousand Seven Hundred and fifty one expressed to be made Between Christopher Hall of the Town and parish of Newtown in the County of Mountgomery Tanner John Savage of the parish of Trefeglwys in the said County of Montgomery and myself by the Name of Christopher Hall of the Township of Maestrefgummer in the Parish of Trefeglwys Son and Heir Apparent of Thomas Hall late of the Township of Maestrefgummer in the said Parish of Trefeglwys and County of Mountgomery aforesaid Gentleman deceased of the one part and Edward Thomas of Manleth in the parish of Llanidloes David Owen of Glandulas in the parish of Llangurig both in County of Mountgomery Gentlemen and Anne my Wife by the Name of Anne Thomas Second and Younger Daughter of the said Edward of the other part A Power is reserved for me to charge the Messuages Lands Tenements and Hereditaments thereby referred to our being described in my late Father and Mother’s Marriage Settlement and other Lands Tenements and Hereditaments therein particularly mentioned with any Sum of Money not exceeding the Sum of One Hundred Pounds for payment of my Debts or portioning my Younger Children by the said Anne my wife, And Whereas I did at the last great Session held in and for the said County of Montgomery suffer a Common Recovery of the Premisses in the said Articles mentioned and referred to with an Intent of Carrying the said Articles into Execution and having a Settlement made pursuant thereto which hath not been yet accomplished Now it is my Will and I do hereby declare (as I have already done by the Deeds lending the Uses of the said Recovery) that the Messuages Tenements Lands and Hereditaments in the said Marriage Articles mentioned and referred to and in the last mentioned Deeds particularly described shall be for such Uses intents and purposes as by the Purport and true Sense of the said Articles appears to be meant and intended And in pursuance of the said power of Charge and all and every other power me in that Behalf enabling, I Do hereby charge all my messuages Lands Tenements and Hereditaments with the Appurtenances abovementioned or referred to (except the messuage Tenement and Lands called Llwyn Tew with the Appurtenances) Subject to the Jointure made or intended be the said Articles for the said Anne my Wife with payment of the Sum of One hundred pounds and de hereby desire and authorize my Father in Law Edward Thomas Gentleman and my good Friend John Savage of the said parish of Tref Eglwys in the said County of Montgomery Gentleman and the Survivor of them and his heirs to raise and levy by and out of the the Rents Issues and profits of my said messuages Lands Tenements and Hereditaments or by Mortgage or Sale of a Competent part thereof or by all any or either of the said Ways and Means the said Sum of One hundred pounds and to apply so much of that Money in paying off all such Debts or [*] or shall owe at the Time of my Decease other than and except the Mortgages which affect part of my Estate that my personal Estate will not extend to satisfy and as for the Remainder of the said Sum of One hundred or the whole thereof if my personal Estate will be sufficient to discharge my said Debts to be paid to my Youngest Daughter Elizabeth when she attains the Age of One and twenty years of her Day of Marriage whichsoever shall first happen with the legal Interest thereof to commence immediately after my Decease, but in Case my said Wife shall happen to have Issue by me another Daughter or Daughters in my life time to be born or in due time after my Decease then my will is that such Daughter or Daughters shall have an equal Share and Benefit of the said one hundred pounds or the remaining part thereof with my said Daughter Elizabeth to be paid at the Age of One and twenty Years or Day of Marriage whichsoever shall first happen with Interest as aforesaid, but born in my life time or in due time after my Decease then my Will is that my Daughters Mary and Elizabeth shall have the said Sum of One Hundred pounds or so much thereof as will remain after payment of my said Debts to be equally divided between them and paid at their respective Ages of One and twenty Years or Days of Marriage whichsoever shall first happen with the legal Interest thereof as aforesaid It being my Intent and Meaning that such Child or Children as I have or shall have by the said Anne my Wife besides such Child as will inherit my Estate should have equal Benefit from the Charge made for my younger Children and that the Survivors and Survivor of such Younger Children or Child shall have the Share of such of them as will die before then part becomes payable as aforesaid And in Case there be no such Younger child living to become intitled to such provision as is hereinbefore made for them, then I direct that the said Charge as farr as it relates to the portioning of my Younger Children shall merge into the Inheritance for the Benefit of the person that will enjoy my said Estate And as for the said Messuage Tenement and Lands with the Appurtenances call Llwyn Tew, I give and devise the same unto the said Edward Thomas and John Savage and their heirs In Trust that they the said Edward Thomas and John Savage and the Survivor of them and his heirs shall by and with the Rents and profits of the said Premisses pay and keep down the Interest of the Mortgage or Incumbrances nowthereon and after deductingTaxes Outgoings and Charges for necessary Repairs of the Premisses to pay the Remainder of the said Rents and Profits to my Brother Thomas Hall and John Hall in equal Shares untill such time as such Child as I now have or shall have by the said Anne my Wife shall inherit my Estate under my said Marriage Articles and attain the Age of one and twenty years and when such Child shall arrive at that Age I do charge and subject the said Tenement of Llwyn Teus with the Sum of Eighty pounds to be then raised by the sd Edward Thomas and John Savage or the Survivor of them and his heirs and equally divided between and paid to the said Thomas Hall and John Hall my Brothers and Subject to such Charge and the Incumbrances at present thereon, I give and devise the said Messuage Tenement and Lands with the appurtenances called Llwyntew unto such Child and have or shall have by the same Anne my Wife that will take and enjoy under my said Marriage Articles my other real Estate and his or her heirs for ever but in Case I shall have no child by my said Wife that will live to inherit my said l[ ] and being in possession thereof attain the age of one and twenty years to clear [*] I purpse the Charge made for the Benefit of my said [will?] as aforesaid then my Brother Thomas Hall having my whole Estate by descent my will and meaning if it shall so happen is that my Brother John Hall only should have the Benefit of the Charge I have here by made on the said Tenement of Llwyn Tew and that immediately after my Brother Thomas will become seized of my real Estate, I give and bequeath all my goods Chattells Stock and personal Estate whatever unto my dear Wife I give in the first place to discharge my funeral Expences and the Charge of proving my Will and in the next place to pay off(?) except Mortgages which the Estate [*] shall happen [*] my personal Estate or [*] amount to more than my Debts.arr as the same will extend all my Debts, I give the residue and remainder thereof to my said Wife and Daughter Elizabeth to be equally divided between them and lastly I Do hereby nominate constitute and appoint
