- Page 73-74 In Name of God Amen I CHARLES WALLER County Stafford Gent make this my Last Will & Testament Imprimis I give to my loving Son JOHN WALLER (after the death of his Mother) the land whereon I now live on Acquia Creek on condition that he pay each of his surviving Sisters the sum of Twenty pounds current money as they severally come to age. Item I give unto my loving Son CHARLES WALLER Tract I bought of THOMAS HOOPER at Brent Town under the following limitations & provisions vizt that my son John shall have the use of one moiety of the said land until the death of his Mother & that upon her death John becoming possessed of the land on Acquia he shall give up the whole to my son Charles Charles paying unto John 88 pounds current money which is 1/2 price I gave for it and that Charles pay unto each of his surviving Sisters the sum of Twenty pounds current money as they come of age. But as my wife ELIZABETH is at present privily Ensient if the child of which she shall he delivered should be a boy my will is that John should only have the use of half my land at Brent Town until death of his Mother that he becomes possessed of my land at Acquia & then I give to the child with which my Wife is privily Ensient if a Boy, but if it should be a girl only to have an Equal share with the rest of my Daughters-
- Item I give to my Brother EDWARD WALLER 202½ acres being part of my tract at Brent Town according to a dividing line made between him & me he having joind with me in the purchase and for which Quantity I intended to have made him Deeds had it pleas'd God to spare me.
- Item I give unto my Sister HANNAH WEBB of Essex County 700 pounds of Tobacco in the hands of THOMAS DOBSON of the same county due to me for rent.. Item all the goods in the Store belonging to Capt. ROGER LYNDON he pack'd up & kept until he comes in to receive them and what goods of my own I have in the store along with his I desire may be sold to the highest bidder or Bartered away for coarse goods for the use of my Family at the discretion of my Executors. As also what goods :I bought of Messrs. ROSSE and RAE & BURGESS & put in the Store along with the said Lyndons goods for the better assorting of them may upon a Settlement with him be deducted out of his part .. put with the rest of my Estate to use of my family. Item I desire my Executors as soon as possible sell my 5 & 20 hogshead Flatt for the benefit of my Estate. Item that my Sawyers be kept at their business for benefit of the Estate. Item all rest I give to be equally divided among my children MARY, SUKEY, JOHN, CHARLES & MILLY WALLER & the child my Wife is now Ensient, that the Division come as they Severally come of age, if any die, share he dually divided.
- Item I give to my loving Wife ELIZA. WALLER the use of my house whereon I live on Acquia during her natural life only & a child's part of my personal Estate. Item my Estate be kept together for use maintenance of my wife & children. Lastly :I appoint my loving wife Elizabeth, my Brother EDWARD WALLER and my good friend Majr. PETER HEDGMAN, Messrs. JOHN PEYTON, GEORGE WALLER & JOHN MAUZY Executors of & Guardians to my Children 2 Dec 1749.

- At Court held for Stafford County 12th Decr 1749 Last Will & Testament of Charles Waller presented into Court by John Peyton & George Waller proved by oaths of witnesses admitted to record Certificate granted for obtaining a Probate.
