DEED OF BENNET HAGAN'S HEIRS TO RANDOLPH HAGAN


This indenture made this 22nd day of December eighteen hundred and twenty six, between the heirs of Bennet Hagan of Nelson County and State of Kentucky deceased of the one part, and Randolph Hagan of Nelson County and state aforesaid heirs for and in consideration of the sum of two hundred and seventy dollars to them in hand paid by the aforesaid Randolph Hagan, the receipt whereof is hereby acknowledged, and the said Hagan by these presents doth fully and clearly exonerate and discharge, they the said heirs of Bennet Hagan deceased hath ranted, bargained, sold, contracted and confirmed unto the said Randolph Hagan his heirs and assigns forever, a certain tract as parcel of land situated laying and being in the County of Nelson, and on the Northern waters of Pottingers Creek, adjoining Benjamin Peltons five hundred acres survey on the southwest, being a part of two hundred acres survey patented in the name of Thomas Carter, containing sixty eight acres more or less, and bounded as follows, South beginning at a black gum and white oak John Donohoos corner thence South seventy degrees West, seventy four and one half poles to two hickories, thence South seventy degrees East, one hundred and forty six and a half poles to a small walnut standing in the original line, thence North seventy West, eighty eight poles to a white oak, thence North twenty nine East, eleven poles and fifteen links to a wild cherry tree, thence North seventy one West, sixty six poles, and twenty two links to a white oak, thence South twenty nine West, eleven poles and fifteen links to the beginning, together with all rights, members, priveliges and ppurtenances unto the aforesaid tract of land belonging or in any wise appertaining to have and hold, the aforesaid tract or parcel of land with the priveliges and appurtenances to him the aforesaid Randolph Hagan his heirs and assigns forever, to the only proper use and benefit of him the aforesaid Randolph Hagan his heirs and assigns forever, and the said heirs of Bennet Hagan deceased for themselves their heirs and assigns doth further covenant and agree to and with the aforesaid Randolph Hagan his heirs and assigns that the said land and premises with its appurtenances unto him the aforesaid Randolph Hagan his heirs and assigns from them the said heirs of Bennet Hagan deceased their heirs and assigns, and from all persons whom soever claiming the said land and premises shall and will warrant and forever defend by these presents... In testimony whereof the aforesaid heirs of Bennet Hagan deceased hath for himself his heirs and assigns set their hands and affixed their seals the day and year above writen.
