"No 973 Banister Malone is entitled to 200 acres of second rate land...lying on the south side of the Cumberland river beginning at a beach tree marked B.M. running thence nearly North to the river bank thence down the river & from the beginning nearly South for quantity including his improvement." The children of Bannister and Patsey Malone were: Jordan Alexander, Leonidas and Sarah "Sally" who married William Patton in May 1834. From other records in Adair County, Bannister married second to Delina Dillingham in Sep 1823. They were divorced in 1841 following action filed in June of that year.
Note it appears that Bannister Malone is residing in the home of his son Jordan Allen Malone in the 1840 census in Davidson Co., TN

William Caldwell and George Wagley, merchants operating as Wagley and Caldwell vs William Butler, Elkanah Butler aand Bannister Malone -- Filed 22 June 1826, box 9 -- In 1825 Malone was in debt to Wagley and Caldwell. They sued and obtained a judgement against him in the Adair Circuit Court, but it appeared that he had no pproperty. Malone also owed money to the Bank of the Commenwealth which also recovered a judgement against him in Adair Circuit Court and they levied on 50 acres of land which was part of a tract owned by him that contained 146 acres. The land was sold to Parker Cc. Hardin and William Butler purchased the remainder. William Butler, Jr. is mentioned in Malone's answer to the charge. William Butler sold the land in question to Elkanah Butler. An amended bill, dated 29 Jun 1827, stated, "since he filed his original answer, William Butler has attained the age of twenty one..." J. Walker was guardian of Butler.
