He was mortally wounded during a Civil War battle at Murphreesboro December 31, 1862 and died January 8, 1863. His father, Augustus Peter Burr, who served with him for a time in the confederate war, went to Murphreesboro to collect his son's belongings, according to Elizabeth Jane Milligan Treadway, Burr's great-granddaughter.
