p. 4,(about 1705) 'To secure the marriage settlement, William Clarke, Sr., had borrowed money on a bond from William Houston. ... ostensibly to meet the debts of William Clarke, Sr. Anthony Houston, heir of William Houston, had obtained judgement against the heirs of William Clarke, Jr., ...' [William Clarke, Sr. died in 1705]...In 1718 Anthony Houston then petitioned to bring a Bill into the House of Assembly to permit the sale of the house in dispute. Several witnesses alleged that Hamilton was the real promoter of the Bill and had financed Houston's petition... They enclose a letter dated Phialdelphia 16 September 1731 ... We were the trustees who sold the house of William Clark to Anthony Houston at a public sale ...Additional Answers of interest are from Henderson Houston, eldest son and heir of Anthony Houston and executor of William Houston; Jonathan Houston and William Dixon, executors of the will of Anthony Houston. they say that Anthony Houston made a will 29 Jun 1724 and that two of the executors, James Robinson and Rowland Fitzgerald, are now dead. Anthony Houston died shortly after making his will, disposing his estate "away from this deponent (Henderson Houston) excepting a small legacy.'



From Jim Houston Ancestry Houston Board Citing:New Castle County, Delaware Land Records 1715-1728:

"Deed. ON 18 Feb 1725 Jonathan Houstown, executor of Anthony Houstown, late of the county of New Castle, gentlemen dec. to Col. John French of the City of New Castle. Whereas Anthony Houstown made his will dated 29 June 1724 & devised unto Jonathan Houstown all of the residue of his estate. Now Jonathan Houstown, son & executor of Anthony Houstown, for L 100 granted to Col. John French a lot of land in the City of New Castle bounded by the street fronting the river, the market place, a lot of Thomas Tresse & another street. Signed Jonathan Houstoewn. Delivered in the presence of James Miller & R. Robertson. Recorded 25 May 1727 (H1:152)

Jim notes in the above note message that he suspects that this Anthony Houston is the one born in Whithorn parish, Wigtonshire, Scotland before 1672, and dies in Kent CO DE about June 1724. Speculates that Johnathan, son of Anthony, is the father of James who died c1760 in Kent Co DE

28 Apr 1728 HOUSTON/GARRETSON - Jonathan Houston of New Castle County, farmer is selling part of an island to Cornelius Garrittson of New Castle Countynty, carpenter, for £50; it is to belong to Garritson unless Jonathon Houston pays £50 to Garrittson by 28 April 1732. It is one undivided half of Island and marsh at Christiana Creek commonly called Swart Nutton Island alias Switzers Island, with one undivided half of an [outlet?? - or perhaps “Outlot”?] on the south side thereof called Beshy. Witnesses: Robt Gordon, David French. Ack in court 17 Aug 1728. Deedbook I:5

18 Sep 1729 HOUSTON/LEWDEN - Jonathon Houston of New Castle in New Castle Countynty, carpenter is selling to John Lowden/Lewden, farmer, an undivided half of Swart Nutton Island and an "Out Lott" of 100 acres for £30. Witnesses: Jacobus [-?-] & Cornel. Garretson. Ack in court third Tuesday Aug 1729. Deedbook I:144. [see 28 Apr 1728; there is no mention in this Houston/Lewden deed of a note or mortgage attached to the property]

The Govr. having, when last at New Castle, received an Order under the Proprietrs. hand & Seal, dated the 20th of April, 17O9. It was read in these words, viz: William Penn, Propr. Govr. in Chief of the Province of Pennsylvia. and Counties of New Castle,Kent & Sussex, upon Delaware. To Coll. Charles Gookin, my Ltt. Governour in the said Province and Counties, & the Council of the same, Greeting:

Whereas, I have been given to understand by the Petition of Anthony Howston, that one Wm. Howston, brother of the Petitr. became bound with one Thos. ffrench to your immediate predecessor, Coll. John Evans, in the Penalty of Two Hund'd. pounds, money of England, Conditioned that if the said Thos. ffrench was married according to the method used in the Church of England, in pursuance of a Certain marriage License granted by the said Coll. Evans for that purpose; Then the sd. Obligacon to be void, or else to stand in full force. And Whereas, the said Thos. ffrench, as it was suggested sometime after, was married by a Presbyterian ministr. after method used in their Congregations, as he Lawfully might be, well by Virtue of the Act of Tolleracon in Engld. as by the law of Liberty of Conscience in Pennsylvia. Therefore, the said Coll. Evans put the said bond in suit, obtained a Judgment, & had Execucon awarded against the body of the said Wm. Howston, whic was Executed, and he is now in Custody, as it is said for Non payment of the said Penalty to the said Coll. Evans. But for as much as this seems to me to be inconsistent with the fundamental Constitution of my Province & of Liberty of Conscience, the great Inducement to most of the people to settle the same.
