The Will of James TERRELL, Planter

In the name of God, Amen, I James TERRELL plant'r of St. Margarets Parish, & County of Caroline in

the Colony of Virginia, am weak in Body but in a perfect Sense & memory, thanks be given to Almighty God. Therefore calling to mind the Mortality of my Body, and knowing that it is appointed for all men once to die, do make and Ordain this my last Will and Testament, that is to say, Principally revoking & disannulling all other Wills heretofore made by me; first of all I give & Recommend my Soul into the hands of God that gave it to me, and my Body to the Earth to be Buried in a Christian like manner; nothing doubting but at the general Resurrection to receive the same again by the might power of God; and as touching such worldly Estate wherewith it hath pleased God to bless me with in this Life, I gave and dispose of the same in the following Manner and Form, viz't.

Secondly. I lent unto my beloved Wife Margaret a Childs part of my Estate, be it in what place or of what

nature or quality Soever, and after my loving Wife Margarets decease my will & desire is that part I lend her should be divided equally between my five oldest children, viz't William TERRELL, Mary Herndon, my son James TERRELL, Betty Newton and Patty Hord.

Thirdly. What I have given heretofore to my eldest son William TERRELL, being a full part of my Estate, to tedious to mention at this time, hoping he will take it kind enough of me, not being well able to give

him any more of my Estate.

Fourthly. I give & bequeath to my son James TERRELL, the Tract of Land wheron I now live and my

Still as it now stands, & also the fifth part of my Stock after my s'd Wifes part is taken out of my Estate, to him & his Heirs & Assigns.

Fifthly. I give & bequeath to my Daughter Betty Newton, one Negro wench named Janes, to her and her

heirs and Assigns.

Sixthly. I give & bequeath to my Daughter Patty Hord one Negro wench named Fortune to her & her

heirs and Assigns.

Seventhly. I give and bequeath to my son John TERRELL two hundred Acres of Land, lying on the north

side of Muddy Creek in Cumberland County and five pounds of curr't money, to buy him some stock, to him and his Heirs & Assigns for ever.

Eightly. I give and bequeath to my son Dudley TERRELL two hundred Acres of Land lying on the south

side of Muddy Creek in Cumberland County joining the s'd Land as I have given to my son John TERRELL and a fifth part of my Stock, to him and his Heirs & Assigns for ever. And the fifth part of my house hold goods after my s'd Wifes part, to him and his Heirs and Assigns for ever.

Ninthly. I give and bequeath to my Son, Jonathan TERRELL, three hundred acres of Land lying in Culpeper County, and the fifth part of my stock & household Goods after my s'd Wife's part is taken out, to him &

his Heirs & Assigns for ever.

Tenthly. I give and bequeath to my Daughter Neffe one negro girl named Rose, and the fifth part of my

Stock & house hold Goods after my s'd Wifes part is taken out of my Estate to her & her Heirs and Assigns for ever.

Leventhly. I have and bequeath to my Daughter Mary Herndon one negro boy named Charles, to her and

her Heirs and Assigns for ever.

Twelfthly. Remembering from the beginning of my Will that all my just Debts & Burial Charges are to be

paid before any division of my Estate made between my loving Children; also my Will and desire is, that if any of my aforesaid Children should be so disturbed at this my Will and Occasion Lawsuits to interrupt my Terrell Trails 1512 Will, that they him or her shall be paid by my Executors one Shilling Sterling and cut of from all other part of my Estate and the part of my Estate left them by this my Will should be equally divided between my Contented Children.

Lastly, I do appoint and Ordain my Son in Law Thomas Hord and my Loving Son James TERRELL Executors to this my last Will and Testament.
In witness whereof I have set my Hand and fixed my Seal the eighteenth day of October, in the Year of our
