David Smith's Will (Transcription) In the name of God Amen. I David Smith of Botetourt County, Virginia, being weak in body, but of sound and disposing mind, do ordain this to be my last Will and Testament, revoking all others made or designed by me. My Land I give to my son Telemacus, also my negro woman Becky, my girl Eliza, and Mary. I give to my wife Eleanor, Lucy and Mary. To my daughter Helannar, I bequeath Fanny, and Ann, and three of Fanny's boys; George, Preston, and Sam. My boy James, I give to my son Telemacus. My boy John, I wish sold and the money arising therefrom approiated to the discharge of my debts. To James Davidson and Sally his sister, children of Betsy Ann Davidson (and said to be mine) I will and bequeath to each of them Thirty Dollars to be made out of the sales arising from my stock. To wit: a bay mare, cattle, hogs, and sheep. The sum of thirty dollars to be made in the same way as that willed to James and Sally Davidson. I also will and bequeath to Betsy Ann Davidson the remaining part of my stock of every kind after the above sums of money are made. I will and bequeath to my wife Eleanor and her two children Telemacus and Helannar all my household and kitchen furniture. I will and bequeath to my wife and two children Telemacus and Helannar my waggon, farming utensils, and the crop now growing. I will and bequeath to my wife and two children Telemacus and Helannar, untill my son Telemacus becomes of lawful age, I will my land to be rented and the proceeds arising therefrom to be applied to the education and support of him, while my wife continues single. I wish my son to remain with her and until he is of lawful age, provided he be well treated, if not it is my wish that a suitable guardian be selected with whom I wish him to continue. I lastly constitute and appoint Capt. David Rowland of Pattonsburg to be my Executor of this my last Will and Testament. Verified by: Signed: David Smith Wm. H. Know all men by these presents that I Benjamin Smith of the County of Kanawha and Commonwealth of Virginia do Authorise Constitute and appoint and by these presents have authorised Contributed and appointed my son Aron Smith my true and lawful agent and attorney in fact to Ask demand sue for and receive from the Executors or administrators of my mother Hannah Smith and my two Brothers Aaron & David Smith all three of whom were late last named of the County of Botetourt in said Commonwealth Decd all my part and right of the several Estates of the said Hannah Aaron & David to which I am entitled by law and should have been no will or wills made by the said Decd and no letters of administration taken Out I do further authorize and empower my said agent and attorney to take such steps with my Ca[hean] or others in possession of said Estate or Estates or any part thereof as will be requisite and necessary to procure my part thereof hereby ratifying and confirming all acts whatever which my said attorney may lawfully do in the premises and his receipts given for said part or parts of said Estate or Estates to be binding on me my Heirs Executors administrators and assigns to all intents and purposes whatever as fully and compleately as if I ware personally present and acting in the same in Witness whereof I have hereunto set my hand and affixed my seal this 6th day of October 1828 Benjamin Smith (x his mark) Kanawha County to wit We Daniel Ruffner and John P. Turner Justices of the peace in the County aforesaid in the state of Virginia do hereby certify that benjamin Smith a party to the foregoing power of attorney bearing date October the 6th 1828 and hereunto annexed personally appeared before us in Our County aforesaid and acknowledged the same to be his Act & Deed and desired us to Certify the said acknowledgement to the Clerk of the County Court of Botetourt in Order that the said Power of attorney be recorded Given under our hands and seals this the 7th day of October 1828.
