Deed of Title by Aaron Martindale to Joel Rollin

To have and to hold the said piece and parcel of land and premises and every part & parcel thereof with its appurtenances unto the said Joel Rollins, his Heirs and Assigns to the only use and behoof of the said Joel Rollin his Heirs & Assigns forever by virtue of these present, subject nevertheless to the terms and conditions, provisions, limitations, restrictions and reservations in the Letters Patent of the said Township of Stanbridge set forth and contained.

And the said Aaron Martindale in the presence of us the said Notary and Witnesses for himself his Heirs, Executors, Curators and Administrators, did and doth hereby grant and covenant to and with the said Joel Rollin, his Heirs & Assigns, that he the said Aaron Martindale and his Heirs the said piece & parcels of land and premises, and every part & parcel thereof with all and singular its rights, members & appurtenances, unto the said Joel Rollin, his Heirs and Assigns against him the said Aaron Martindale and his Heirs and against all persons whomsoever shall & will warrant and forever defend by these presents.

And the said Aaron Martindale in the presence of us the said Notary and Witnesses voluntarily declared and acknowledged that the Grant & Conveyance is thereby him made pursuant to a bargain of sale of the same piece of land herein before described by him made and entered into with the said Joel Rollin previous to the sale and adjudication of the said premises by the Sheriff of the District aforesaid to him the said Aaron which bargain was that he the said Aaron should if the same be legally done cause the said Joel Rollin’s name to be substituted to his own in the Title Deed which the said Sheriff hath executed to & in his the said Aaron’s favor of & on the said premises on the fourth day of the present month of October therefore further declares that although his name instead of the said Joel Rollin’s inserted in the above mentioned Deed, he nevertheless consents & agrees that at all times hereafter and in all respects soever said Joel Rollin his Heirs and Assigns be entitled to claim the same benefits, rights and privileges that he the said Joel could by virtue of the said Deed have been entitled to, if the same has been executed & delivered to him the said Joel. And for the due execution of these presents, the Parties, therefore have respectively made election of their Domicile of Stanbridge aforesaid where &c notwithstanding &c promising &c obliging &c renouncing &c thus done and passed at said St. Armand in the office at the said Notary in the after noon of the ninth day of October in the year of our Lord, one thousand eight hundred and twenty-eight in the presence of Jabez Chadburn and Nahum Chadburn, the said Witnesses and the said Parties & me the said Notary Witnesses have to these presents first duly read, set & subscribed our respective names, in faith and testimony of the premises.
