Transcript

I, James Crockett of the County of Clarke of State of Kentucky being of sound and disposing mind and memory but aged and infirm in body do make ordain publish and declare this Instrument of writing to be my last Will and Testament evoking all other heretofore made. In the following manner Vise – In the first place I will and desire all my Just Debts to be paid out of the ______ bequeaths hereafter to be mentioned in equal proportions according to the estimate of each Donation.
Secondly, I give & bequeath to my Sons John & Samuel Crockett all the Land I possess lying on the South Side of Hancock Creek in Clarke County & one hundred and Sixty acres lying on Miami in the Ohio State to be equally divided between them.
Thirdly. The Land I live on, on the North Side of Hancock Creek I give and bequeath to my son James and Daughter Susanna Crockett and also one hundred acres lying on Ha----- Creek in the County of Estill to be equally divided between them.
Fourthly, I give and bequeath tom my Daughter Margaret Stevenson one Negro Woman named Sali.
Fifthly I give and bequeath to my Daughter Polly McPheeters one Negro Girl named Judi, but the said Polly is to pay my Daughter Patsy Harrison one hundred and fifty dollars at the time of taking the said Negro Judi in possession.
Sixthly, I give and bequeath to my son James Crockett one Negro Boy named Dave.
Seventhly I give to my son Samuel Crockett one Negro Boy named Eli.
Eighthly, I give and bequeath to my Daughter Susanna Crockett two Negroes by name, Charlotte and Ben.
Ninthly, my will & desire is that the separate Horses now claimed by my four Youngest Children individually be not considered as part of my Estate but to be by them ___ as of this right & independent title.
Tenthly, I give and bequeath all my Horses not heretofore given, all my Cattle, Sheep and Hogs to my Sons James and Samuel and my Daughter Susanna to be equally divided between them.
11th, I give and bequeath to my Daughter Susanna one choice half of my Household and Kitchen furniture and the Balance to my Sons John and Samuel to be equally divided between them.
12th, I give & bequeath unto my sons James and Samuel my Wagon and gun and all my Farming Utensils to be equally divided between them.
Be it understood that I have given to my Son Robert Crockett all that I was able as intend to give him. I only bequeath him Ten Dollars to be paid by my Excrs.
Having given in the same manner to my Daughter Elizabeth Hamilton. I only bequeath her Ten Dollars.
To my Daughter Jane Black, the same Ten Dollars to be paid by my Excrs also.
Be it known to all the aforegoing bequeaths are to be held by the aforegoing legatees and thus heirs forever.
And lastly, I appoint Isaac Cunningham, George Carlile, and my son James Crockett Excrs. of this my last Will & Testament Given under my Hand and seal this twenty eighth Day of July one thousand eight hundred and thirteen. Signed, Sealed, Published and Declared by the said James Crockett to be his last Will & Testament in presence of D. Bullock, George Fry, Jr., Josias Bingham Bullock

At a Court held for Clarke County November 22, 1813 This Last Will and Testament of James Crockett Deceased was proven according to Law by the oaths of George Fry, Jr. and Josias Bingham Bullock Witnesses thereto Succumbed and ordered to be Recorded. James Crockett one of the Executor’s herein named refusing the burden of the Executorship of said will and on the Motion of Isaac Cunningham one of the Executor’s herein named who made oath thereto as the Law directs. Certificate is granted him for obtaining a probate thereof in due form giving security whereupon he together with Samuel Crockett, Robert Crockett, Robert Cunningham and James Crockett in this int____ into and acknowledged their Band in the finally of $8000 cash detained according to Law for the due and faithful administration of said ____dents Estate and performance of his will Liberty being Reserved the other Executor therein named to join in the probate of this Will when he think fit.
