Image Licensing [25 September 2011]

Hello, I am a volunteer admin and it's my job to help people learn the system. You asked for help licensing your images. I can't license your images but I can give your guidance. There are numerous licensing options, but most images fall into one of these categories:

  • Original published in US before 1923
  • Low resolution copy of an historical photograph. (When you reduce the image before upload, the resolution is reduced.)
  • Snippet of historical document
  • Work of US government--Public domain
  • If you took the picture, select the CC-BY-SA
  • If you know the photographer, get written permission.

This photo was almost certainly taken before 1923, but the photographer is unknown. In general, would a professional photographers work before 1923 be public domain?--Brear47 09:06, 25 September 2011 (EDT)


As long as it was published before 1923. If the photo was not published it does not become public domain until 70 years after the death of the author. However, if your scan is a lower resolution than the original, i.e. you reduced it, it would probably fall under the fair use doctrine even if it is not yet public domain.--sq 17:55, 1 December 2011 (EST)
