This James M. lived on his brother, Roberts, land for 20 odd years after his brother, Robert, first purchased it from the Borden Heirs in May 1751. He was first known as Captain when he and others were called out when the Looneys homestead was attacked by indians in 1764. They were forted at the Fort on Craigs creek.

This James M. married one Mary Moore the widow of Captain John Moore that died in 1760 while fighting indians on the western frontier of North Carolina.

The marriage license between this James M. and Mary Moore can be found in the marriage records of Rowan Co. NC.

The Captain James Montgomery that married Mary Robinson, widow to John Robinson that died in 1755 at Vause's Fort was a son of Michael and Margaret Montgomery of Davis Creek branch of Rockfish River in Amherst Co. Va.

This James with wife Mary along with Thomas and his wife Ann, went back to Amherst Co. Va. in 1771 to sale the 500 acres they had inherited to a Mr. Harris. Bother James and Thomas lived near the Holston River near Abingdon Virginia. Thomas died there in about 1803 and James had a personal property estate list dated 1808 in Fayette Co. Va. One William Davis gave a deposition in about 1808 in Washington Co. Va. where he tells of Mary Robinson widow of John Robinson. Mr. Davis says she was a sister to Col Wm. Robinson and Col David Robinson. This Captain James Montgomery married this Mary Robinson in 1760 according to a lawsuit Madison vs Robinson.--Michael Shuman 06:45, 18 January 2023 (UTC)

FYI: James, John, and Thomas Montgomery, sons of Michael and Margaret, were Processioned by Sheriff Robert Breckenridge in 1755 as inhabitants of the lower end of Augusta Co. Va.

This suggests that we look at the Statutes at Large, Laws of Colonial Virginia by Hennings. Where it state that in order to own land in Colonial Virginia you had to meet one of three criteria. 1,to be male of 21 years. 2,to be the eldest surviving male heir. 3. to be male and have a family of his own to provide for.

With that being said, we must believe that James, John and Thomas were all over the age of 21 years or they had a family of thier own to provide for.--Michael Shuman 06:53, 18 January 2023 (UTC)
