    Will. In the name of God Amen. I William Schwartz of the Town of Oneonta in the County of Otsego and State of New York considering the uncertainty of life and being of sound mind and memory (blessed be God) do make publish and declare this my last will and testament this twenty sixth day of February in the year of our Lord one thousand eight hundred and forty five, hereby revoking all wills heretofore made by me in manner and form following viz
    I give my body to the earth whence it came and my soul to God who gave it.
    Secondly I give and bequeathe to my beloved wife Marillis all my personal property to be at her disposal and the profits arising from all my real estate ? to be at her disposal during her natural life.
    Thirdly I give and bequeathe to my son Peter one half of house farm to be equally divided between himself and his brother William Henry but not to be by him disposed of until after the decease of his brother John and Abraham.
    Fourthly I give and bequeathe to my son William Henry our equal half of my home farm to be divided between himself and his brother Peter but not to be by him disposed of till after the decease of his brother John and Abraham and in case the said William Henry should die previous to the death of his present wife then the property [to him?] bequeathed to go to his children but if he should outlive his present wife he may dispose of the property as he may [think?] but after the death of his mother and brothers John and Abraham.
    Fifthly I give and bequeathe to my two sons John and Abraham forty acres of land which I bought of James Adams lying south of the highway and west of George Schwartz farm but since they are incapable of providing for themselves or of managing their own affairs whoever shall take care and provide for them shall have the profit of the land during their natural life and the land after their death.
    Sixthly I give and bequeathe to my daughter Elizabeth two hundred dollars to be paid equally by Peter and William Henry but not to be paid by them unless they choose till after the decease of John and Abraham and
    Seventhly and lastly I give and bequeathe to my two youngest grand daughters by the [name?] of [Ward?] children of my daughter Nancy, deed to the elder of them one cow and five dollars when of age and to the younger five dollars only when of age this be ? to be paid equally by Peter and William Henry. I do also hereby appoint my son Peter Schwartz and Henry Couse as executor of this my last will and testament.
    Signed Sealed published and declared to be my last will and testament in the presence of us who have hereunto set our [hands?] in the presence of the testator. The word Nancy between the 7th and 8th lines from top on the last page ? ? before executed. The [attrition?] of executor from Harry to Henry Couse made before signed also the word William thrice inserted on the first page and twice on the last.
