"Sheriff's Sale. -- By virtue of an execution issued out of the Clerk's Office of Otsego county and to me directed and delivered, against the goods and chattels, lands and tenements of Peter W. Swart, I have levied on all that certain piece or parcel of land, situate, lying and being in the town of Oneonta, county of Otsego, and bounded as follows, to wit: On the north by the Susquehanna river; on the west by lands of George Swart; on the south by the line of what is commonly known as the Franklin patent; and on the east by lands lately owned by Henry Swart; containing about one hundred and twenty acres of land. Also, one other piece of land, in the town aforesaid, bounded on the north by the highway, on the west and south by lands of John Hackitt, and on the east by George Swart, containing about forty acres, be the same more or less; which said described premised, by virtue of said execution and pursuant to the statute in such case made and provided, I shall expose to sale at public vendue on the tenth day of August next, at one o'clock in the afternoon, at the house of John Clark, in the town of Laurens, selling all the right, title and interest of the said Peter W.     Will

    I, Peter W. Swart, of the town of Oneonta, in the county of Otsego and state of New York, do make, publish and declare this to be my last Will and Testament in manner following viz:

    First: I direct the payment of all my just debts and funeral expenses and charges for suitable and proper tombstones for my grave to be paid out of my personal property.

    Second: I give, devise and bequeath unto my son Elkanah Swart all my real estate and all the rest and residue of my personal property after fulfilling the above "First" clause of this my last Will and Testament. But I hereby obligate and enjoin upon my said son that he shall allow unto my wife, Asenath Swart, during her natural life the free use and occupation of the west part of my dwelling, being the part used by my mother at the time of decease, also the west bedroom upstairs and privilege of going to and returning from there at all times, also right-of-way to the cellar - privilege [?] wood shed for keeping fuel - use of necessary ground for a garden, and all necessary privileges by her needed in and about the yards to said house appertaining. I also require my said son to pay to my said wife annually during her life the sum of seventy dollars, and to keep for her one milk cow so long as she shall choose to keep one; and I hereby declare that the above reservations so made for my wife, privileges granted, annual payments, and keeping of said cow as above enumerated are to be in full lien and claim of all right of dower in and to my property of every name and kind. And I further enform upon my said son and obligate him to pay at the decease of my said wife, the sum of two thousand dollars to my daughter Eleanor Stillson, and the sum of three hundred dollars to my grand daughter Ella Swart.

    Third: I hereby desire it to be understood that in case my said wife will take my brother Abram Swart and keep him during his life, then she is to have the forty acre lot where Mrs. [? ?] now lives to dispose of as she may see fit.

    Fourth: I hereby enform upon my son Elkanah the duty and hereby oblige him to expend and lay out the sum of one hundred dollars in a good and judicious manner upon my cemetery lot in Oneonta Village the same to be done within a reasonable time after my decease and in case of failure or refusal so to do, then I obligate my said daughter to cause the same to be done, and the bequests gifts and devises above made to my son Elkanah are to go to my said daughter and all right and [?] of my said son to the same to cease.

    Fifth: The foregoing bequests to my wife, daughter and grand child are to be a lien and charge upon my real estate for the payment thereof, and I make said real estate chargeable with the payment thereof and collectible therefrom in case my said son does not pay the sum and every of the sums as the same respectively become due and payable.

    Lastly: I hereby nominate and appoint my son Elkanah Swart and my son-in-law John Stillson to be Executors of this my last Will and Testament, hereby revoking all former wills by me made.
