  • 7 Apr. 1832: John Tyler & Elizabeth his wife, Isaac Scott and Patsey his wife and other Plaintiffs: against; Jonas Pierce in his own right and a administrator of William Dillard dec'd., Larkin London & Polly his wife, James Dillard and other defendants: The Plaintiff John Tyler being dead on the motion of Elizabeth Tyler his administratix with the will annexed it is ordered that this suit stand reviewed and be hereafter and noted in her name, and the subpoena awarded in this cause being returned executed upon the defendans Larkin London & Polly his wife and James Dillard and more than four months having elapsed as well since return day there of as the filing of the bill and they still failing to apperar and answr and the defendants John Haggard and Rachel his wife and Peter Moore and Susanna his wife who are absent from the commonwealth of virginia and against whom the plaintiffs appear to have proceeded in the mode prescribed by law in relation to absent defendants still failing to appear and answer upon motion of the plaintiffs the bill is taen for confeped as to the said defendants; and this cause coming on to be further heard upon the papers formerly read the exchibits and examination of witnesses was argued by councel on consideration where of the court doth adjudge order and decree that the defendant Pierce render before one of the commissioners of the court an account of the rents ? & profits of the land in the bill mentioned which have accured since he has had the pessision as contrat thereof, and the same commissiner is directed to take an account of the advancements, made by the said William Dillard dec'd. in his lifetime to either of the plaintiffs or defendants. or with which either of them is chargable wich accounts the said commissioners directs to state and to the court report with any special matter deamed pertenant by him or which either party may require, that he report also to the court, what property real and personal remain for division and destribution & what will be the value of the share of each of the heirs of the said intestate of the real thereof if decred to be sold before division.
  • 4 Sep. 1832: Elizabeth Tyler administratix whith the will annexed of John Tyler dec'd. and in her own right, Isaac Scott & Patsy his wife and other Plaintiffs: against Jonas Pierce in his own right and as administratior of William Dillard dec'd., Larkin London and Polly his wife, James Dillard and other Defendants: On the motion of the defendant Jonas Pierce by councel and it apperaring to the court that he deliveed his vouchers to Edmund Norwell late a commissioner of the superior court of chancery for the Lynchburg district, when ordered by that court to render an account fefore one of the commissioners, whelst this cause was depending in the said superior court of chancery, it is orderd that Seluda Nowell administratix of the said Edmund Nowrell the summoned to appear here at the next term to show cuse if any she can why she does not deliver to the said Joas Pierce his vouchers as aforesaid to her intestate.
  • 6 Sept 1832 p. 39: Elizabeth Tyler administratrix with the will annexed of John Tyler dec'd. and in her own right, Isaac Scott & Patsey his wife, Mildred Innis widow of John Innis dec'd, Oney Garner widow of Joseph Garner dec'd. Plaintiffs against Jonas Pierce in his own right and as administrator of William Dillard dec'd. Larkin London and Polly his wife, James Dillard and other defandents: On the motion of the defendant Jonas Pierce, and it apperaring to the court from the report of commisssioner Robert Tinsley, that the plaintiff Elizabeth Tyler, Isaac Scott and Oney Garner, decline to have the accounts in the cause made up in purusance of teh direct order made there in the 7th day of April last, or further to proecure the same at their expnese and it further apperaring to the satification of the court that the plaintiff Mildred Innis is not an inhabitant of this state, on the motion of the said defendant by his attorney it is ordered that their writ be dismissed at the next term unless security for the payment of such costs and damages as mayt be awarded the defendants and aso of the fees which will be come due from the Plaintiffs to the officers of the court be given with the cinsideratin sixty days from this time.

  • 5 Apr. 1834: Elizabeth Tyler administratix with the will annexed of John Tyler dec'd, Isaac Scott & Patsy his wife, Mildred Innis Widow of John Innes dec'd. & Oney Garner widow of Joseph Garner ded'd. Plaintiffs against Jonas Pierce in his own right and as administrator of William Dillard dec'd., Larkin London and Polly his wife, James Dillard & other. On answer of the defendant Jonas Pierce by council it is ordered that unless the plaintiffs after being served with a sopy of this order do diligently pursue the necessary measurer to mature this case for hearing, by bringing in the commissioners report made in purruance of the order made in his cause on the 7th day of April 1832 the court will at a furture day dismiss this bill.

Plaintiffs against Jonas Pierce in his own right and as administrator of William Dillard dec'd., James Dillard son of William, Larkin London and Polly his wife, and Robert, Thomas, William, and Levinia Warren infants by commissioner Benaugh Specially assigned their guardian ad litcm John Haggard amd Rachel his wife and Peter Moore & Susannah his wife Defandents: This cause came on this day to be heard upon the papers formerly read and the report of commissioner Tinsley made in perisuance of the duretal order of the 7th day of April 1832 with in asslems theresents by the defendant James Dillard and the exhibets therewith filed and was argued by councel. On consideration whereof the court not at present deciding any points arising in the cause except as to the Plaintiff Mildred Innis doth conferm the said report as to her and doth adjudge oreder and direct that the defendant Jonas Pierce do pay the amount due from him to the said plaintiff on account of rents of the real estate with interest to be computed after the rate of six per cent per annum on ninety six dollars and ninety four cents part thereof from the 7th day of February 1834 bill paid & that the said Jonas Pierce do also pay to the said plaintiff one hundred and twenty four dollars and fifty four cents being the amount appearing from the aid report to be due from him to the plaintiff on account of the personal estate of his intertate with interest to be compuled after the rate of six per cent per annum on eighty eight dollars and sixty one cents part thereof from the 7th day of Feb. 1834 till payment. But thesaid plaintiff is not to have the benefits of this delivered as to the certification until she or some one for her shall enter into bond with sufficent security in the clerks office of the court payable to the defendant Jonas Pierce administrater of William Dillard dec'd. in a penalty agreed to double the sum decreed to her as her protion of the personal estate, with condition to refund due proportions of any debts or demands which may after3wards appear against the estate of his estate and the costs attending the recovery of such debts or demands. And the court do the further order that the report aforesaid with the escceptions there to be reccommetted to the commissioners who made it for him to consider and report thereupon.

Elizabeth Tyler administratix with the will annexed of John Tyler dec'd, Isaac Scott & Patsy his wife, Mildred Innis Widow of John Innes dec'd. & Oney Garner widow of Joseph Garner ded'd. Plaintiffs against Jonas Pierce in his own right and as administrator of William Dillard dec'd., James Dillard son of William, Larkin London and Polly his wife, and Robert, Thomas, William, and Leanna Warren infants by commissioner Benaugh Specially assigned their guardian ad litcm John Haggard amd Rachel his wife and Peter Moore & Susannah his wife Defandents: This cause came on this day to be further heard upon the papers formerly read and an exhibit since filed and was argued by coucil in consideration whereof it appearing from the certificate of the clerk of the county court of Amherst filed as an exhibit in this cause that the defendant Jonas Pierce hath taken admistration upon the estate of Peter Moore and Susanna Moore they must be presumed to be dead and the court can at present make no decre as to their interest. And the court being of opinion that the defendant Pierce should not be allowed to speculate upon the desenbuties of his intestate by purchasing up their shares in the estate whil it he heed it in his hands for administration and that he should only be allowed in the settlement of his accounts with them as much as he paid for such share or shares and approving and confirming the special statments of the commissioners as th those shares which the said administrator had bought up (except those of Elizabeth Tyler and Oney Garner which are refured back to thecommissioner for further examination) and overruling and setting aside everything in conflict with what followeth doth adjudge order and decred that the said Jonas Pierce as administrator of William Dillard dec'd. do pay to the plaintiffs Isaac Scott & Patsy his wife two hundred and eighty two dollars and ninety six cents with interest at the rate of six percent perannum on two hundred ona fifteen dollars and eight cents start thereof from the 7th day of February 1834 bill paid and that the said Jonas Pierce as receiver of the rents to pay to the said plaintiff Issac Scott and Patsey his wife thirty one dollars and sixty four cents with like interest on twenty four dollars and sevety seven cents thereof from the 7th day of Feb. 1834 till paid. That the said fdefendant Jonas Pierce pay to the defendant William Warren twenty two dollars and ninety seven cents with like interest on eighteen dollars and ninety one cents from the 7th day of Feb 1834 till paid. to the defandt Thomas Warren twenty two dollars and ninety seven cents with like interest on Eighteen dollars and ninety one cents part thereof from the 7th day of Feb. 1834 bill paid, to the defendant Leanna Williams twenty two dollars & ninty seven cents with like interest on eighteen dollars and ninety one cents part thereof from the 7th day of Feb. 1834 bill paid, to the defendants John Haggard & Rachel his wife in right of the latter twenty two dollars and ninety six cents with like interest on eighteen dollars and ninety cents part thereof from the 7th day of Feb. 1834 till paid. and to the aforesaid parties respectively such costs as they may incure in carrying the aforesaid decree intocreation. But the said Isaac Scott and Martha his wife are not to have the benifit of this decree until they shall enter into bond with sufficent security in the clerks office of this court payable to the defendant Jonas Pierce administrator of William Dillard dec'd. on a penality equal to double the device aforsaid for $282.96 and interest therein as aforesaid William Warren, Thomas Warren, Robert Warren, Leana Williams and John Haggard and Rachel his wife are not to have the benefit of this decree until they shall on like manner enter into a refunding bonds payable as aforesaid and conditions as aforesaid, the said William, Thomas, Robert, & Leana in the penalty of $100 each and the said John Haggard and Rachel his wife in a like penalty with sufficent security and there being no other decree asked to this time the cause is continued to awrit the further report of the commissioners heretofore and none ordered and leaves touching the subject matter of the accopunts depending before said commission.

Plaintiffs against Jonas Pierce in his own right and as administrator of William Dillard dec'd., James Dillard son of William, Larkin London and Polly his wife, and Robert, Thomas, & William Warren infants by commissioner Benaugh Specially assigned their guardian, Leana Williams, John Haggard amd Rachel his wife and Peter Moore & Susannah his wife Defandents: It appearing to the court that in entering the decree made in this cause on the 9th day of Sept 1835 the amount due from the defend and Jonas Pierce to the defendant Robert Warren as appearing by the report of Commissioner Tinsley made in puresuanced of the durectal order of the 7 day of Apr 1832 the special statement of which report was heretofore by the court was not decreed to the said Robert Warren through inddvertence, the court setting aside the order of continuanee herein made on Wednesday last so far the decree now her followin is concerned dothe adjudge oder and decree that the said Jonas Pierce do pay to the said Robert Warren lllltwenty two dollars and ninety seven cents with interest to be computed at the rate of six per cent per annum on eighteen dollars and ninety one cents part thereof from the 7th day of Feb. 1834 till paid and such costs as he may expend on having excuition of this decree.

Elizabeth Tyler administratix with the will annexed of John Tyler dec'd, Isaac Scott & Patsy his wife, Mildred Innis Widow of John Innes dec'd. & Oney Garner widow of Joseph Garner ded'd. Plaintiffs against Jonas Pierce in his own right and as administrator of William Dillard dec'd., James Dillard son of William, Larkin London and Polly his wife, and Robert, Thomas, William & Leana Warren infants under the age of twenty one years, by commissioner Benaugh Specially assigned their guardian, John Haggard amd Rachel his wife and Peter Moore & Susannah his wife Defandents: This cause came on to be further heard upon the papers formerly read exhibits since filed and report of commissioner Tinsley made in pursuance of the decretal order of the 7th day of April 1835. On consideration whereof the court confirming the said report only for the present as to the accounts therein stated between the defendant Pierce and the plaintiff Mildred Innis and Oney Garner and between him and the defendants Haggard and wife and the Warrens, doth adjudge order and decree that the plaintiff Oney Garner pay to the defendant Jonas Pierce fifteen dollars and thirty nine cents with interest thereon to be computed at the rate of six percent fer annum from the 3rd day of October 1835 till payment. An on motion of the said Jonas Pierce who brought into court the amount reported in favor of the plaintiff Elizabeth Tyler with interest thereon up to this day amounting in the whole to thirty eight dollars and twenty four censt. The same was paid to Robert Tinsley deputy clerk of the court who is appointed a receiver for the purpose and directed to hold the same until it shall be applied for by the said plaintiff and then pay it over to her and the said defendant Jonas Pierce having paid to Larkin London and to the councel of Mildred Innis, William Warren, Thomas Warren, Robert Warren, Leana Willias, John Haggard and Rachel his wife the sums reported in their favor respectively as appears by the recepts filed no decree as to them will be necessary and tthe said defendant Jonas Pierce under the direction of the court also paid to the said Robert Tinsley deputy clerk the sum of fifty nine dollars and fifty cents being the amount reported on favor of the defendant James Dillard with interest thereon up to theday in discharge of his liabelity for that amound and which the said Robert Tinsley is directed to pay over to the said James Dillard on Application and as to all other matters this cause is retained for futher proceedings.

By consent of the plaintiffs and of Wiatte London administrator of Larken London who hath departed this life the court do the order this suit stand revised against the said Wiatt London on his churader aforesaid and on motion of the defendants Jonas Pierce and James Dillard the court doth order that the saem be continued till the next term.

This cause came on this day to be heard upon the papers formerly read the examinations of witnesses since filed and was argued by councill. On consideration wherof the court not being at this time advised what decree to render doth thake time to consider thereof till the next term.

Elizabeth Tyler administeratrix with the will annexed of John Tyler dec'd., and her own right, Isaac Scott, and Patsey his wife Mildred Innes widow of John Innes dec'd. and Oney Garner widow of Joseph Garner dec'd. Plaintiffs against Jonas Pierce in his own right and as administerator of William Dillard dec'd., James Dillard son of William, Wiatt London administrator of Larkin London dec'd. Polly London, and Robert, William, & Thomas Warren infants under the age of twenty one years by commissioner Benagh specially assigned their guardian, Leanna Williams, John Haggard & Rachel his wife, Peter Moore & Susanna his wife Defendants: This cause came on to be heard upon the papers formely read and the exhibits and examinations of witnesses since filed and was argued by council, on consideratiion whereof the court if of opnion that the defendant Dillard has shown no excuse for neglecting to take his evidence and appearing ad presenting his pretensions before the commissioner while engaged on and before closing his 2nd accounts taken and reported to the court and cannot now be allowed to impeach those reports by the affidavits and deporations since taken - They were at a former arms confirmed and decreed upn as to all the parties except this defandent and wones have been as to him, for the court was then satisfied, but for the earnest and portion a cort appeals of his councell for continuation almost every term since. The court did not en part when there continuance were granted to see give the new testimony when it should decide the case without deciding therefore houw far the testimony since taken whether for of against by Perce or Dillard wouyld if read and considered effect the discision of Dillards exceptins to the set? and report but considering them upon the testemony before the commissioners and before the court when it prounced its former decrees, said exceptions are over ruled and the reports confirmed as to all parties - The balance due form the defendant Jonas Pierce as administrator to James Dillard appearing on the commissoners last report has been paid into court finder the order of the 6 day of April 1837 and remains in the hands of the clerk adjudged to his order, but the said report having been closed in 1835 does not of course include the hire of Dillard slaves for that or any subsequent year yet as nothing is theron to the contrary it is presumed that Pierce surrendered up the hier bond when he delivered up the slaves if he has not he must still do so. And it being ascertained that the defendants Peter Moore and Susannah his wife are still alive and it being agreed by their council and the defendant Pierce that they are entitled to fifty dollars on account of their portion of the hires of the slave Parker ux to this day and to one hundred and thirty three dollars and thirty three cents on account of their interest on the said slave this day sold to the said Jonas Pierce besides the sum of seventy three dollars and sixty eight cents appearing due to them upon the last report, the court paid clerk adjudged order and decreee that the defendant Jonas Pierce pay to the said Peter Moore & Susanna his wife two hundred and fifty seven dollars with interest on twenty five dollars and fourty eight cents a part there of from the 3 day of Oct. 1835 till payment, and on one hundred and ninety four dollars and fourty two cents other part ther of from the date here of all payment. But the saud Peter Moore and Susannah his wife are not to have the benefit of this decree until they or some one for them shall enter into bond with sufficent security in the clerks office on the persally of $300 conditioned to refund their due proportion of any debts or demands which may afterwards appear agaend the estate of the said William Dillard dec'd. and the costs that attend the recovery of such debts or demands. As to the small balance reported as being due from Isaac Scott and Patsey his wife they are to small for seperate decrees authorising exceutions to issue on fain of each party whereby the amount would be geatly augmented with costs the court doth therefore adjudge order and decree that the Isaac Scott pay to Samuel Garland who is appointed to recover for the purpose the whole amount to wit fifteen dollars and ninty eight cents with interest thereon from the 31 day of Feb. 1835 till paid. this ends the cause except as to the two doubtful debts outstanding mentioned in the report which if ever collected will be subject to distrubation and as to the costs: and the cause court adjudged order and decree that the said Jonas Pierce pay to the plaintiffs their costs by them about their witnesses their behalf."
