A transcription of his will [proved 24 Oct 1710]:

In the Name of God Amen. I Timothy Cooke of Birdingbury in the County of Warwick Clerk being put in mind of my mortality by present indisposition of body but having the perfect use of my understanding & memory thanks bee given of God. doe make this my last Will and Testamt that is to say First commending my Soul to God the giver of it, trusting in his mercy & meritts of my Saviour I desire my body may bee decently enterr’d without any needless expense, in the Church where God has been pleas’d for Severall of the last Years of my Life to appoint me his Minister; And as for my Worldly Goods I bequeath them as followeth. first I give & bequeath to my Eldest Son John Cooke all my Lands & Estate lying & being in the Parish of Marton in the sd County of Warwick for and During the Term of Ninety Nine Years if my sd Son John shall so long live & after the determination of the Term or his Decease which shall first happen to the first son of the body of my sd Son John lawfully begotten, or to be begotten and for default of such Isue to the Second, Third, Fourth, Fifth, Sixth, Seventh, Eighth, Ninth, Tenth & every other Son & Sons of the body of My Sd Son John lawfully to be begotten & for default of such Isue I give & bequeath all my foresd Estate in the Parish of Marton to my Second Son George Cooke & his Heirs for Ever Item I give to my sd Son John Three broad pieces of Gold; and the Summe of Thirty Shillings Yearly to bee paid him out of the Land which I have purchased at Radford untill such time as my Grandson Timothy Cooke the Son of my s’d Son George shall attain the age of one and twenty Years, To whom from that time forward I bequeath the sd Thirty Shillings to be paid him Yearly as my Legacy to him during his life: but if my Son John Cooke shall happen to be so unkind & unjust to his brother George as by any conveyance to deprive him of the inheritance of the Estate in Radford which was his Mothers having no Child or Children lawfully begotten of his own body to inherit it then & from that time forward the sd payment of Thirty Shillings Yearly to my Son John Cooke shall cease & determine & immediately to become Payable to my Grandson Timothy Cooke, Item. I give and bequeath unto my Son George Cooke to him & his Heirs for Ever all my Lands & Estate in Burdingbury and what Lands I have purchased in Radford, the latter onely being subject to the Yearly paymt of Thirty Shillings as is already express’d Item. I hereby constitute & appoint my Son George Cooke my Sole Executor of this my last Will & Testam’t and give unto him all my personall Estate he paying my Funerall charges and all Debts & what Legacys I either have already mention’d or or shall add by way Codecil to this Will Dated the two and Twentieth day of January in the 2d year of our Soverign Lady Queen Ann and in the Year of our Lord according to the Computation of the Church of England One Thousand Seven Hundred and Three.
