He died without a will before 11 July 1829, as shown by the relinguishing of Dower Rights of his widow, Mary Wilson as follows:
This Indenture made this 11th day of July 1829, between Mary Wilson, relick of Thomas Wilson, deceased of the County of Russell and State of Kentucky, of the one part and the heirs of Thomas Wilson, dec. of the other part of the County and State aforesaid Witnesseth that the sd. Mary Wilson, relick of Thomas Wilson dec. for and in consideration of One Dollar to her in hand paid, by the said above mentioned heirs and natural love and affection, having bargained, Granted and sold to the above mentioned heirs (Viz.) Rice Wilson, Moses Wilson, Joseph Wilson, Thomas Wilson, James Wilson, William Smith, William Stephens, and Benjamin Gilley all an equal part of the estate, all the real and personal estate of Thomas Wilson, deceased, that is remaining in the State of Virginia, the sd. Mary Wilson, relick of Thomas Wilson deceased, do hereby relinguish her right of Dower and do by these presence covenant and agree to and with the above mentioned heirs that she will forever quit claim to all and every article of personal and real estate of Thomas Wilson, dec. that is remaining in Virginia, In testimony whereof the sd. Mary Wilson, relick of Thomas Wilson deceased, have hereunto set her hand and seal this day and date first above written.

I, William Patterson, Clerk of County Court for the aforesaid, do certify that on the day of the date hereof, Mary Wilson, the grantor of this conveyance came before me in my office and acknowledged the said Indenture to be her act and deed and that I have recorded the same, together with this certificate in my office as required by law. Given under my hand this 20th day of July 1829. Book B. Page 41 - Will Patterson.
Also, on Juoy 25, 1829. the eight heirs settled part of the estate in Henry Co. Va. by a Deed from seven of them to the eighth, and the children mentioned at that time were Rice, Moses, Joseph, Thomas, and James Wilson, William Smith, William Stephens and Ben J. Gilley to Ben J. Gilley, one of the heirs. The last three named all married daughters of this Thomas Wilson, all living in Russell County, KY. except Ben J. Gilley, who was then living on the land in Henry Co. Va. Also a Power of Attorney of seven of these same heirs all in Russell Co, KY. Book 12, Page 74, dated August 8 1838, appointing Ben J. Gilley of Henry Coounty, Va. Power of Attorney for Joseph Wilson, William Stephens, James Wilson, Rice Wilson, Moses Wilson, William Smith and Thomas Wilson of the first part and Thomas Nunn of the other part of the County of Henry, State of VA. Titles and claims of above as heirs of Thomas Wilson, dec., all their interest to lands on Great Fork in Henry Co., Va. (except land heretofore sold to Benjamin Gilley and Morgan Harris) to Thomas Nunn 160 acres of land. Thomas Wilson and Mary Adams were married March 24, 1784 and their eldest child was born March 24, 1786.
