A transcription of his will: I Thomas Harbert of Fenny Compton in the County of Warwick Yeoman being sick and weak of body but of sound mind memory and understanding for which I praise God do for the settling of my Worldly Affairs make this my last Will and Testament in manner following (that is to say) first I will and direct that all my Just Debts my funeral and testamentary Expences and the Expences of proving this my will shall be fully paid and satisfied I give devise and appoint to my Nephew Richard Harbert of Wiggington in the County of Oxford Yeoman all my Lands Tenements and Hereditaments whatsoever situate at Harbury in the said County of Warwick now in the occupation of Thomas Palmer to hold to my said Nephew Richard Harbert his heirs and assigns for ever I give to my Brother William Harbert the sum of fifty pounds to my Sister Mary the sum of fifty pounds to My Sister Sarah the sum of fifty pounds to my Nephew William Chater the sum of fifty pounds and to my Nephew John Harbert the Sum of fifty pounds to be paid to them respectively within one year next after my decease Whereas my Nephew James Harbert owes me one hundred pounds for the Security whereof I hold his promissory Note Now it is my will and desire that my Executors shall within one year next after my decease call in the said one hundred pounds and I give the same as follows to the said James Harbert the sum of twenty five pounds part thereof to my Nephew Thomas Harbert twenty five pounds other part thereof to my Niece Elizabeth Harbert twenty five pounds other part thereof and to my Niece Mary Harbert twenty five pounds other part thereof to be paid to such of them as shall there have attained the age of twenty one years within one year next after my decease to such of them as shall not then have attained the age of twenty one years within one year next after the attainment of such age or ages and I do hereby give devise and bequeath all the rest residue and remainder of my Estate Money Debts Goods Chattels and Effects whatsoever and wheresoever and of what nature kind or sort soever unto my Nephew the said Richard Harbert his heirs Executors Admors and Assigns for ever And I do hereby nominate constitute and appoint my Nephew the said Richard Harbert the Executor of this my last Will and Testament hereby disannulling and revoking any former wills In testimony whereof I the said Thomas Harbert the Testator have hereunto set my hand and seal this twenty second day of July in the Year of our Lord Christ one thousand eight hundred and seven Thomas Harbert Signed sealed published and declared by the said Thomas Harbert the Testator as and for his last Will and Testament in the presence of us who in his pressure of his request and in the presence of each other have thereto subscribed our Hands as Witnesses thereto J Shorley Surgeon John N Hall Edwd Matthews Chipping North. This Will was proved at London on the fourteenth day of April in the Year of our Lord One thousand eight hundred and eight before the right honorable Sir William [...] Knight Doctor of Laws Master Keeper or Commissary of the Prerogative Court of Canterbury lawfully constituted by the Oath of Richard Harbert the Nephew of the deceased and the sole Executor named in the said Will to whom Admon was granted of all and singular the Goods Chattels and Credits of the said deceased he having been first sworn by Commission duly to Administer References
