  • Vol. 2 - Thomas Rust vs. Chastein--O. S. 172; N. S. 61--Bill, 6th June, 1806. Orator's father, Samuel Rust, died 1798 testate (will in Westmoreland). Lewis Chastein became orator's guardian. Lewis Chastein formerly living in Frederick County, was in 1811 living in Kentucky. Will of Samuel Rust of Parish Caple of Westmoreland County. Grandsons, Samuel Rust, Samuel Crabb, Thomas Rust (300 acres purchased of Mathew Kenner, Daniel Tebbs, Thomas Allison, Presley Cox); daughter, Elizabeth Crabb (land purchased of Presley Cox and Ro. Jeffries); devisee Hannah Atwell, daughter of Mary Beale; devisee Richard Atwell, son of William Atwell; legatee Nancy Atwell, daughter of William Atwell; legatee Molly Atwell, daughter of William Atwell; legatee Charlotte Atwell, daughter of William Atwell; sister Hannah Banghus, (Baughus); grandson Thomas Rust; legatee Susanna Keene; executors William Atwell and John Crabb, Sr. Dated 21st March, 1798. Recorded in Westmoreland 28th January, 1799. (Note on back of will): Jeremiah Rust married an Attwell. Her brother died 1788 intestate, leaving Mrs. Rust and a minor sister, Miss Attwell, who lived in Jeremiah's family. Jeremiah died about 1791 or 92; his widow married Chastine, the plaintiff; the minor sister married one Middleton; both died about year ____; Middleton left a will.

Will dated 21 Mar 1798; proven 28 Jan 1799
In the Name of God Amen I SAMUEL RUST of the Parish of Cople and County of Westmoreland, and in the State of Virginia, calling to mind the uncertainty of this Transitory life, do make and ordain this my last will and Testament in manner and form following, Imprimis.
I give unto my Grand son SAMUEL RUST my Gun,
Item I give unto my Grandson SAMUEL CRABB my Silver watch,
Item I give unto my Grandson THOMAS RUST the Land and Plantation whereon I now live containing Three Hundred acres (be the same more or less) whichI purchased of MATHEW KENNER, DANIEL TEBBS and part of THOMAS ALLISON and a part I purchased of PRESLY COX, from JEFFRIES CORNER STONE, NORTHEAST TO THE ROAD THAT LEADS TO YOUCOMOCA WAREHOUSE, to him the said THOMAS RUST and his heirs forever.
Item, I give unto my Daughter ELIZABETH CRABB one Hundred and Fifty acres of Land which I purchased of PRESLY COX and ROBERT JEFFRIES to her and her heirs forever,also I give to my daugher ELIZABETH CRABB two Negro Men, Will, and Soloman, to her and her heirs forever.
Item I give unto HANNAH ATTWELL Daughter of MARY BEALE, Twenty five acres of Land, Joining the Land I formerly gave her by Deed of gift, from the RED OAK TO A LINE TREE FORMERLY BETWEEN ALLISON AND KENNER TO A WHITE OAK ON BENNETTS LINE to her and her Heirs forever. I also give her the use of Two Negroes, London and Joane during her Natural life, and after her Death, and her Husbands to be Equally divided, amongst all her children,
Item I give unto RICHARD ATTWELL son of WILLIAM ATTWELL, one Negro Boy George by name,
Item I give unto NANCY ATTWELL Daughter of WILLIAM ATTWELL, one Negro Boy named Daniel,
Item I give unto MOLLY ATTWELL Daughter of WILLIAM ATTWELL one Negro Boy named Frederek,
Item, I give unto SHARLOTT ATTWELL Daughter of WILLIAM ATTWELL one Negro Girl named Molly to her and her heirs,
Item I give unto my Sister HANNAH BANGUS the use of one Feather Bed and furnature so long as she stays in the neightborhood, Also I give unto my siad Sister the hire of a Negro Fellow named Daniel to be hired by my Executors, and the said Fellow to chuse his master yearly during her natural life,
Item I also give unto my Grandson THOMAS RUST Two Negro men named ... and job,
Item I give unto SUSANNAH KUNE (sp) a Small Blue Chsest Commonally called hers, and a Small Flaged Sitting Chair, also Ten pounds Cash to be paid her at the age of Sixteen, to be paid by my Executors hereafter named,
Item my Will is that the Remaining part of my Estate not yet given, be divided into Three Equal parts, One third part to ELIZABETH CRABB & her heirs, one Third part to THOMAS RUST, and his heirs, and the other third to WILLIAM ATTWELLS CHILDREN,
I do hereby Revoke, Disannul and make Void, all other Wills Testaments and legacees, by me herebefore made Ratifying and Confirming this to be my last Will and Testament, and I do hereby constitute nominate and appoint, my Friends, WILLIAM ATTWELL and JOHN CRABB SENIOR to be my Executors to this my last Will and Festament, In Witness whereof I have hereunto set my hand and seal this Twenty first day of March Anno Dome One Thousand Seven Hundred and Ninty Eight.

At a Court held for Westmoreland county the 28th day of January 1799. The aforegoing last Will and Testament of Samuel Rust senr. deceased was proved accoring to Law by the oaths of Jeremiah Jeffried and John Cutchen Two of the witnesses thereto and ordered to be Recoreded, And on the motion of william Attwell one of the Executors ... named who made oath thereto according to Law and together ...
