Estate Dispute

Articles of agreement made and entered into between Mary Price Alias Mary Wright and Archibald Wright of the one part, and Abner Watson in right of himself and Polly his wife & William Price of their part. Witnesseth: That the said parties being desirous of puting an end to all contentious and disputes relative to the estate of Richard Price deceased, and in order that all suits and controversies may likewise end between; and that a fair and amicable division of the said Richard Prices estate may now take place, arguably to the true intent and meaning of their Articles
Viz: the said Mary Price alias Mary Wright does agree to keep the possession of old Rese, Daphney and her child, Rose, Brister, and little Silvia, all of which said Negroes are now in her possession; and also the said Mary does agree to keep what furniture, she hath in her possession, which did belong to the said estate, and to furnish the said William with a good new bed and furniture, in full satisfaction of his claim on the estate of the said Richard Price deceased, and not to receive or Claim any other part of the said Estate which belonged to the said Richard at the time of his death or which his representatives at any time since have been entitled to. And the same Abner Watson and Polly his wife and the said William Price, in consideration of the premises do hereby agree to give up all right or claim to the said negroes & furniture (the said Mary finding the bed aforesaid) to the said Mary and her heirs by the said Archibald Wright forever. And the said Mary in consideration thereof do hereby agree to give up all the rest of the estate of the said Richard [Price], as aforesaid, to the said above Watson & Polly his wife, and the said William Price, to them and their Heirs forever. And the parties do further agree that in case any debt shall come against the estate of the said Richard Price deceased, to pay the same, if its right to do so, in proportion to the estate each of the parties is entitled to under this division, and the said parties do further agree that all suits now depending shall be dismissed as agreed between them, and that each shall pay their own costs; and that from hence forward each party shall give up to the other what they are entitled to by these articles without any delay, and that there shall be a firm peace and mutual friendship. And the sd. Abner, and William do also agree that the estate of the said Richard Price deceased, which they are now entitled to by this agreement shall be divided between them agreeably to the will of the said Richard Price dec'd in the same manneer as if the said Mary was now dead. Its understood by the parties, that the negroes now in possession of the Archibald and Mary, not before named, are not to be delivered up until the first day of December next.
In witness whereof each party do hereby bind themselves to the other under the penalty of one thousand pounds current money to keep good their covenents and thereupon they have affixed their hands & seals this 30th July 1796~

The orasures? in these articles of the name of Archibald Wright in five lines were made before the same were signed: and in the eighteenth line the words by the said Archibald Wright were interlined before the same were signed.

Examined. At a Court held for Cumberland county the 22nd day of August 1796.
This agreement was acknowledged by Creed Taylor as to himself and by William Anderson, Creed Taylor as to others and ordered to be recorded.
