Probate of the Last Will and Testament of Norman H. BRIGGS, late of Malone, NY, deceased.

Surrogate's Court Franklin County

Be it remembered, that heretofore, to wit: On the 31st day of January 1891, Henrietta BRIGGS, Executrix named in the Last Will and Testament of Norman H. BRIGGS, late of Malone, in the County of Franklin, deceased, applied to the Surrogate of the County of Franklin to have the said Last Will and Testament, which relates to both real and personal estate, proved and recorded, and on such application the said Surrogate did ascertain, by satisfactory evidence, who knew the widow, heirs of law and next of kin of said deceased testator and their respective residences, viz.: Henrietta BRIGGS, Clarence BRIGGS, Royal A. BRIGGS, and Charles BRIGGS, all of Malone, NY and said Surrogate did thereupon issue a citation in due form of law, directed to the above named heirs at law and next of kin by their respective names stating their places of residence, requiring them to appear before the said Surrogate at his office in Malone Village, in said County, on the 10th day of February A.D. 189! 1, to attend the probate of said Will and afterwards, to wit on the 10th day of February 1891, at Malone Village aforesaid, satisfactory evidence having been presented to the said Surrogate of the service of the said Citation in the mode prescribed by law on all of the above named persons, no one appearing to oppose the probate of said Will, the said Surrogate took the proofs of said Will hereinafter set forth, and did thereupon adjudge said Will to be a valid Will of real and personal estate, and the proofs thereof to be sufficient, and that the said Will and the proofs thereof be recorded; which said Last Will and Testament, and the proofs taken thereon are as follows, that is to say:

In the name of God, Amen.

I, Norman H. BRIGGS, of Malone, Franklin County, New York, being of sound mind and memory, and considering the uncertainty of this frail and transitory life, do therefore make, ordain, publish and declare this to be my last Will and Testament, that is to say:

First. After all my lawful debts are paid and discharged, I give and bequeath unto my beloved wife all my property of every name and nature to have, hold and enjoy the same in the support and maintenance of herself during her natural life and the support and maintenance and education of my children during their and each of their minority. And the residue and remainder of my property that remains after the death of my said wife, Henrietta, I give, devise and bequeath the same unto my said children, Clarence W., Royal A., and Charles BRIGGS, share and share alike, to have, hold, and enjoy the same forever. I give and grant unto my Executrix hereinafter named full power and authority to sell and convey any and all my property and execute and deliver any and all instruments of conveyance thereof as fully to all intents and purposes as I might do if living.

Likewise; I make, constitute, and appoint my beloved wife, Henrietta BRIGGS, to be Executrix of this my last Will and Testament, hereby revoking all forms of Wills by me made.

In witness whereof, I have hereunto subscribed my name and affixed my seal, the 26th day of January in the year of our Lord one thousand eight hundred and ninety-one.

The above written instrument was subscribed by the said Norman H. BRIGGS in our presence and acknowledged by him to each of us; and he at the same time declared the above instrument, so subscribed, to be his last Will and Testament; and we, at his request have signed our names as witnesses hereto; in his presence and in the presence of each other, and written opposite our names, our respective places of residence.

In the matter of the Last Will and Testament of Norman H. BRIGGS, Deceased. Examination of witnesses produced, sworn and examined in the above entitled matter.

County of Franklin, ss.

John P. KELLAS and John ROBBS, being severally and duly sworn and examined before Hon. Daniel A. BEMAN, Surrogate of the County of Franklin on behalf of the applicant to prove said Will, do each depose and say as follows:

We were each well acquainted with Norman H. BRIGGS, deceased. That subscription of the names of the said decedent to the instrument now shown to us, and offered for probate as his last Will and Testament and bearing date the 26th day of January in the year of our Lord one thousand eight hundred and ninety-one was made by decedent at the residence of himself in Malone in the presence of us and each of us, subscribing witnesses to said instrument. At the time of his making such subscription the said decedent declared the said instrument so subscribed by him to be his last Will and Testament, and we the undersigned, thereupon subscribed our names as witnesses at the end of said instrument at the request of said decedent, and in his presence and in the presence of each other. That said decedent at the time of so executing said instrument was upward of the age of twenty-one years, and a citizen of the United States, and of sound mind, memory and understanding, and not under restr! aint or in any way incompetent to devise real estate.

It appearing from the proofs duly taken, in respect to the Last Will and Testament of Norman H. BRIGGS, late of Malone, in the County of Franklin and State of New York, deceased; that the said Will was duly executed and that the said Norman H. BRIGGS, at the time he executed the same, was in all respects competent to devise real estate, and not under restraint, the said Last Will and Testament, as a valid Will of real and personal estate, and the proofs and examinations are hereby recorded, signed and certified by me, pursuant to the provisions of the revised statutes this 10th day of February, A.D. 1891.
