The commissioner is directed also to make an account of the purchase money, if any, which may remain due from the estate of Matthew McMullen (the younger) to the heirs of his father for the real estate in the proceedings mentioned, designating to which of the heirs the same may be owing, and in what proportion. The evidence in the cause was not enable the commissioner to arrive at absolute certainty. The time which has elapsed since Matthew McMullen purchased the interest of his father's heir's with the fact that since his death in 1828, no demand has been made upon his administrator by any of them except perhaps __________Gilkerson inclines the mind strongly to the conclusion that they all have paid with the exception of Gilkerson. The names of the heirs of Matthew McMullen [Sr.] are:

5. Daniel McMullen
6. Joseph Withrowe and Elizabeth, his wife
7. Harvey Beard and Mary, his wife

The deposition of Harvey Beard shows that Samuel and William have been paid. A conveyance mailed and a file L from Robert McMullen to Samuel McMullen and Daniel McMullen for one hundred acres of land dated August 26 1811 and another paper in file marked M by which Samuel McMullen in Sept 1816 sold this same land to Matthew McMullen Jr.. This is all the evidence that Robert McMullen has been paid. There is no evidence in relation to Daniel McMullen and Joseph Withrowe and wife, except an account marked N of William McMullen against Withrowe for $105 assigned to Matthew McMullen, Jr.. There are two judgements of________ Gilkerson's adm. against McMullen's sons in this court which supported to be on land given for his interest in the land.
