Will Transcript

I, Jehu Summers of the County of Clay and the State of Virginia do hereby make my last will and testament in the manner and form following that is to say:
1st I devise all my personal property to my present wife Almira at my decease. She to have use of the same until my youngest child becomes of age for her to use the same for the benefit and education of the children she had by me and in case she marries the boys to be bound out to a good trade. The personal property at her death to be divided equally among the children she had by me that's left after raising the children.
Second I do devise the real estate to be sold when the youngest child becomes of age, the proceeds of the same to be divided equally among the children of present wife Almira, she to have one third of the same during her life time and at her death to be divided equally among the children she has by me.
Thirdly I will to my first wife's children one dollar each to be paid out of my estate.
Fourthly I do hereby constitute and appoint my friend John McCutcheon of Nicholas County and Ralph Smith of Kanawha County Executors of this, my last will and testament, above mentioned in witness thereof I have hereunto set my hand and affixed my seal this twenty second day October one thousand eighteen hundred and fifty nine.

    Jehu married first Johanna Davis. She is thought to have a mother
    named Hull and a grandmother named McNutt. Some family members say
    that Johanna is a sister to John Davis who married Phoebe, sister to
    Jehu, and that they were related to Jefferson Davis, the Confederate
    President.
    Jehu married second Miriam (Almira) Cozwald (Cazad). She was born
    in November 1823. Traditional family history states that shew was a
    bond servant of a Simmons family, and that Jehu exchanged a milk cow
    for the reaminder of her indenture in 1844. After the death of Jehu
    she married Charles Lewis October 23, 1873 in Clay County. He was
    born in 1808 in Ceno, NC. In the 1900 census for Clay County she was a
    widow living with her son, David.
