A rebel band of guerillas attacked Athens, Tennessee, then fled. A squad of soldiers under Capt. Samuel Bivens, of the 1st Rgt. Ohio Heavy Artillery gave chase, along with citizen volunteers from Athens. John Rue was one of the volunteers and acted as guide in the gorges of the Chilhowee Mts. NC, since he was familiar with the area. He was carrying a double barreled shotgun and a revolver and during the skirmish with the Rebels he was instantly killed, along with several other of the citizen volunteers. He had been with the squad for two days. A witness to his death said his body was brought back to his friends for burial.
1st Wife: Sarah Lower Rue; children: Andrew, William H., Amanda, Martha E., Paulina E., John R. Sarah Lower Rue was said to be buried at Liberty Hill Church.
2nd Wife: Sylla Matilda Rutherford, m. 1859. She applied for a pension on behalf of his death. Two children under age 16 were named: Sarah Louisa Rue, b. 22 Nov. 1859 and Melvina Tennessee Rue, b. 7 Dec. 1861.
