    In the Name of God Amen I John Kennedy of Whitehaven in the County of Cumberland Mariner being of sound Perfect and disposing mind memory and understanding do make publish and declare this my last Will and Testament in manner and form following that is to say I will order and direct all my just Debts Funeral and Testamentary Expences shall be paid off and discharged by my Executor and Executrix hereinafter named I give devise and bequeath unto my four Children Robert Kennedy Mary the wife of Samuel Hinde John and Martha Kennedy All that my freehold messuage Tenement or Dwelling House situate in Queen Street in the Town of Whitehaven aforesaid Also all those my freehold messuages Tenements or Dwelling Houses situate in a Lane near to Mark Lane in the Town of Whitehaven aforesaid Also all those my two freehold messuages or Dwelling Houses with the Hereditaments situate in a new Street called Preston Street on the Road leading from Whitehaven aforesaid to the Ginns Also all other my real Estate whatsoever To Hold the same with the Appurtenances unto my said four Children their Heirs and Assigns for ever as as Tenants in Common and not as joint Tenants And in case of the Death of any of my said Children in my Life Time leaving Child or Children lawfully begotten then I give the Part of Share Parts or Shares of him or her as well original as accruing which the Parent so dying would have been entitled unto if living unto his or her Child if there shall be only one his or her Heirs and Assigns for ever and if more than one to his or her Children their Heirs and Assigns for ever as Tenants in Common But in case of the death of any of my said Children in my life Time without leaving lawful Issue him her or them surviving I give and devise the Part or Share Parts or Shares of him her or them so dying unto and to the Use of the Survivors and Survivor of them and the Child or Children of any of them who may die such Child or Children taking the Share the Parent or Parents respectively would have taken if living To Hold to them their Heirs and Assigns for ever as Tenants in Common And I give and bequeath unto my said two daughters Mary the Wife of Samuel Hinde and Martha Kennedy All my household Furniture Plate Linen China Liquors Provisions and other Stores with my Printed and other Books Prints Paintings and Pictures and all other my household Effects whatsoever absolutely And as to the rest residue and remainder of my Personal Estate and Effects whatsoever I give and bequeath the same unto and equally amongst my said four Children Robert Mary John and Martha share and share alike And in case of the death of any of them in my Life Time bearing lawful Issue I give and bequeath the Part or Share Parts or Shares as well original as accruing which he she or they would have been entitled unto if living unto his her or their Issue respectively And in Case of the death of any of my Children in my Life Time without leaving lawful Issue I give and bequeath the Part or Share Parts or Shares of him her of them so dying unto and equally amongst the Survivors and survivor of them and the Issue of any of them who may be dead such Issue taking the Share the Parent or Parents would have been entitled unto if living And of this my Will I appoint my said Son Robert and my Daughter Martha Kennedy Executor and Executrix Hereby revoking and making void all former Wills I declare this only to be my last Will and Testament In Witness whereof I the said John Kennedy the Testator have to this my last Will and Testament contained on two Sheets of Paper set my hand and Seal that is to say my hand at the bottom of the writing on the proceeding Sheet and my hand and Seal to this second or last Sheet this sixth Day of May One thousand eight hundred and Thirty
