    [p 7]
State of Ohio County of Lawrence: SS
On this 10th day of December A.D. 1851, before me one of the Judges of the Court of Common Pleas in and for the County and State aforesaid personally appeared Mary Hackworth aged 96 [last digit written over could be 95] years a resident of said County, and concerning whom I certify that she is prevented from appearing in open court by reason of extreme old age and bodily infirmity, and who being duly sworn according to law made the following declaration in order to obtain the benefit of the acts of Congress passed March 3rd A.D. 1837, March 3rd A.D. 1843, June 17th, 1844 and February 2nd A.D. 1848. That she is the widow of John Hackworth deceased who entered the service of the United States under the following named officers and served as herein mentioned. That her said husband was a private in the Company commanded by Captain John Trigg in the Regiment of Virginia Militia commanded by Colonel Pilley Trigg [Lieutenant Colonel William Trigg?] in the war of the Revolution. That he volunteered in Bedford County Virginia some time in A.D. 1781 but she cannot state the exact date, but thinks it was in the fall, and served two successive tours of three months each. That she cannot tell the country which her said husband marched through, but thinks he went about 300 miles in a north east direction. That she has heard him speak of being in some two or three battles or skirmishes, but she has no recollection of the places where they were fought. That he was at the siege of Yorktown, and was present at the surrender of Lord Cornwallis. That the following persons among others served at the same time with her said husband but she does not know that they served in the same Regiment to wit Moses Preston and Nathan Preston who enlisted she thinks under a recruiting officer named Alexander Cummings. That he was honorably discharged at the expiration of his term of service, and she thinks he received a written discharge which, with all papers relating to the matter was destroyed by fire at Floyd County Kentucky about A.D. 1809 and that she has no other documentary evidence to offer neither does she know of any persons now living by whom she can positively prove the services of her said husband.
She further states that she was married to the said John Hackworth in Richmond County Georgia in the spring of A.D. 1788 by one Savage a Baptist Minister, that her maiden name was Mary Preston, that her said husband at the time of her marriage with him was a widow were with five children. That after their said marriage they continued to reside in Georgia about one year, when they removed to near Brushy Mountain and resided about two years from thence they removed to Bedford County Virginia where they resided several years, and then removed to Floyd (afterwards called Pike) County Kentucky where they continued to reside until the death
of her said husband which took place on the 20th day of August A.D. 1826, and that she has ever since remained a widow, and that she has never heretofore applied for a pension. She hereby claims the five years pension to which she is entitled under the Act of March 3rd, 1837 commencing on the 4th of March 1836, the five years pension to which he is entitled under the Act of March 3rd 1843 revived and extended by the Act passed June 17th 1844 and the
continuance of her pension during the period of her natural life under the Act passed February 2nd, 1848.

[p 15: On November 27, 1851, Nancy Hatcher gave testimony in Floyd County Kentucky that she resided in the house of John Hackworth at the time he married Mary Preston in Richmond County Georgia; that they were married at the preachers house she thinks sometime in the spring 1788; that the affiant continued to live with John and Mary Hackworth for a number of years after their marriage; that John died 19 or 20th day of August 1826 in Pike County Kentucky; that John enjoyed a reputation at the time of his death as a soldier of the revolution. She signed her affidavit with her mark.]

State of Ohio County of Lawrence SS
Before me a Justice of the Peace in and for said County and state personally appeared Thomas Hackworth and John Howell to aged and respectable citizens who being duly sworn according to law on their oath said that John Hackworth late of the County of Pike State of Kentucky was for the term of six months a Revolutionary Soldier. That the said John served two tours of duty of three months each in the company commanded by Captain John Trigg in the Regiment of Virginia militia commanded by Colonel Pilley Trigg, that the said John Hackworth went from Bedford County in the State of Virginia, but in what year or month they cannot now exactly say, but there in impression and belief is that he served both tours in the year A.D. 1781, inasmuch as he served at the siege of Yorktown and when Lord Cornwallis was taken [October 19, 1781].
That the said John Hackworth was married to one Mary Preston at the County of
Richmond State of Georgia in the year A.D. 1788 by one Savage a Minister of the Gospel, that they were not present at said marriage but they know that said marriage took place at that time – that the said Mary as the wife of the said John became the Mother of nine children – the oldest of which will be 62 years old next birthday – that from that time to the period of his death (as hereinafter mentioned) of the said John, he and the said Mary lived together as man and wife – that the said John died at the County of Pike State of Kentucky on the 20th day of August A.D. 1826 or thereabouts – That the said Mary is now and has continued the widow of the said John from his said death up to the present time and they further swear that they are disinterested in this matter.

[p 19: Susan Branham gave testimony on December 10, 1851 in Lawrence County of Ohio that she was a resident in the family of John Hackworth at the time he married Mary Preston; that she, the affiant, was not at the wedding but the mother and sister of Mary Preston were in attendance and told the affiant of the wedding; that the wedding took place she thinks in the spring of 1788; that John and Mary lived together as man and wife for many years until his death August 20th 1826 in Pike County Kentucky. She signed her affidavit with her mark.]
[p 23: On July 24, 1854 in Lawrence County of Ohio, Pleasant Hackworth executed a power of attorney authorizing his attorney, Charles F Willard of Cincinnati Ohio, to pursue the claim of Mary Hackworth, deceased, widow of John Hackworth as a soldier of the revolution. He signed the power of attorney with his mark.]
[p 33: On November 5, 1852 in Lawrence County of Ohio Thomas Hackworth and John Howell gave additional evidence reiterating their earlier affidavit as transcribed above and adding the following: "They now state in addition to said affidavit, that there means of knowing of the services of the said John were the following. They knew him well at the time such service was rendered, as well as prior thereto. That they knew him well thenceforward to the time of his death. That they were as well acquainted with the facts connected with his service as they could be and not be in the service with him. That it was the general belief, reputation and understanding, among the people of the neighborhood from which the said John Hackworth went, that he was engaged in the service of the United States at the time – that no one has ever to their knowledge disputed this reputation and they are as firmly convinced that said John Hackworth deceased served as aforesaid, as they are of their own existence. And that they are disinterested." Both men again signed their affidavit with their mark.]
