Will of John Bushong, Sr., Will Dated 1 March 1831. Proved 28 December 1831.
IN THE NAME OF, GOD AMEN! I John Bushong Senior of Lampeter township, Lancaster county, in the state of Pennsylvania, yeoman, being somewhat weak in body, but of sound mind memory and understanding; and considering the uncertainty of this transitory life, do make and publish this my last will and testament, in manner and form following, to wit:
FIRST, it is my will, and I do order, that all my just debts and funeral expenses be fully paid and satisfied out of my estate, as soon as conveniently can be done after my decease.
ITEM, I give, devise, and bequeath to my executors, herein after named, to wit, Henry Bushong, Jacob Bushong and John Bushong Junior, and the survivors or survivor of them, and to their heirs and assigns, a piece or parcel of land situate in Leacock township in said county, containing five acres more or less, now in possession of Samuel Cowan; and a certain plantation situate and being in Rockingham county, in the state of Virginia, containing one hundred and twelve acres, be it more or less, together with the sum of one thousand three hundred and fifty dollars, in cash, In trust, to and for the uses, intents and purposes herein after mentioned, specified, and declared of and concerning the same, that is to say, in trust, that they the said Henry Bushong, Jacob Bushong and John Bushong, and the survivors and survivor of them or their successors, shall and do manage let and rent the lands and tenements, aforesaid, and place the sum of money aforesaid to interest on good security, or invest it in Bank or Government stock, for and during the natural life of my daughter Mary, the wife of Samuel Cowan, and pay her as much of the clear incomes, profits, and interests thereof, (after all charges are deducted) from time to time, as the said trustees, or the survivors or successors of them, shall think proper and fit and as the said Mary's necessities may require, taking her receipts alone for the same, which shall be sufficient discharges, to the intent and purpose, that the same or any part thereof, may not become liable for the debts, forfeitures, or engagements of her present or any after taken husband, but only for her sole and separate use and benefit, the said trustees their survivors or successors, may, if they see proper so to do, rent the said lands to the said Samuel Cowan, or let him and his wife, the said Mary, live in, and occupy the same; and in case the said Mary, should at any time, during her life, become destitute of a home or house to live in, the said trustees may, if they deem it expedient and proper, build a house and stable for her use on the said five acre lot, out of the monies aforesaid; and after the death of the said Mary, then in trust, that the said trustees, their survivors or successors, shall sell and dispose of the said lands and tenements aforesaid, to the best advantage they can, and execute good and lawful deeds of conveyance for the same, unto the purchasers thereof their heirs and assigns in fee; and the monies raised by said sales, together with the monies aforesaid, and any surplus of interest and incomes aforesaid, after all charges are deducted, I give and bequeath unto all and every the children which my said daughter Mary, may leave at her death, including her daughter Hannah, whom she had before her marriage to Samuel Cowan, and to the lawful issue of such of them, as may be then dead; such issue to inherit the share of his, her, or their parent if living; to be equally divided among them.
ITEM, I give to my son Henry Bushong, his heirs and assigns, three hundred and thirty three dollars and thirty three cents, to be paid to him, immediately after my decease.
ITEM, I give and bequeath unto my daughter Elizabeth Bushong, all my personal property, which I shall die possessed of, excepting outstanding monies and cash, and I also give her, my said daughter, one hundred dollars in cash.
ITEM, All the rest, residue, and remainder of my estate, which I shall die entitled to, consisting of sundry outstanding monies and cash, not otherwise bequeathed I give and bequeath to all my children share and share alike, with this provision, that my daughter Mary's share, shall be retained and held in trust by the said Henry, Jacob, and John Bushong, or the survivors or successors of them, for the use of the said Mary, in the same manner and with like intent as the other estate herein before given to them for her use, is to be held, and disbursed, and divided after her death.
ITEM, The reason why my sons Henry, Jacob, and John, and daughter Elizabeth, are to get no more under this my will than what is herein before given to them, is, because I have advanced each of the said Jacob and John, with four thousand two hundred dollars, and Elizabeth with three thousand three hundred dollars in the lands and tenements, which I conveyed to them respectively; and because I have advanced the said Henry with three thousand eight hundred and sixty six dollars and sixty seven cents in cash, for some of which I hold his bonds and notes, which I order to be given up to him without charging him any interest or principal.
ITEM, The rents in arrear on the land in Virginia, shall go into the fund appropriated for the use of my daughter Mary, and her children; and as to rents, services and ...regarding my other children, they shall be taken and deemed as settled.
AND LASTLY, I nominate, constitute and appoint my sons Henry Bushong, Jacob Bushong, and John Bushong, and the survivors and survivor of them, to be the executors of this my will, Hereby revoking all other wills, legacies, and bequests by me heretofore made, and declaring this and no other to be my last will and testament.
IN WITNESS whereof, I have hereunto set my hand and seal the first day of March, anno domini, one thousand eight hundred and thirty one.

Signed, sealed, published, pronounced, and declared by said testator, as and for his last will and testament, in the presence of us, who, in his presence, and at his request have subscribed our names as witnesses.

On the 28th December 1831. Before me the subscriber personally appeared Peter Johns and Israel Carpenter, the subscribing witnesses to the preceding will, who being duly affirmed, according to law, did severally declare and say, that they were present, and did see and hear John Bushong Senior the testator therein named, sign, seal, publish, pronounce, and declare the same, as and for his last will and testament, and at the doing thereof, he was of sound and disposing mind, memory and understanding, to the best of their knowledge, observation, and belief.

December 28th 1831. Letters, testamentary granted to Henry Bushong, Jacob Bushong, and John Bushong, the executors, they being duly affirmed, to administer the estate, and to exhibit and inventory thereof, into the Register's Office, within one month, and an account of their executorship, in one year, or when required; also to comply with the act relating to collateral inheritances.
