Facts and Events
John's mother was his guardian after his father died. He signed for his part of his father's estate October 23, 1813 as distributed by Catherine Brown. The proof that he is the same John Brown who was the son of Robert Brown is found in a deed dated September 13, 1844 between John Brown, Senior and Jacob Dilleshaw. In the deed he states that the land he is selling was part of Robert Brown's tract. There is no other record to show he received the land other than by the inheritance. In his will and in the deed he refers to himself as John Brown, Senior. Further, in another deed his heirs purchased land from William Rice. William Rice was the husband of John's sister, Sally. In the 1808 land division Sally's land adjoined John's. This John's land adjoins William Rice's landed Since William Rice was married to Sally Brown, this deed serves as more evidence linking them as children of Robert Brown. John Brown died intestate in Elbert County. In 1845 his estate was inventoried and John's personal property was sold. Oliver M. Duncan was married to Sarah Brown, John Duncan was married to Nancy Brown, William Rosser was married to Susan D. Brown and Lauchlin (Laughlin) McCurry was married to Elizabeth P. Brown. All four men, along with the sons and other daughters of John Brown, Senior received distributive shares of the estate according to the return reported in 1855. Georgia This Indenture made and entered into this first Elbert County day of January in the year of our Lord one thousand Eight Hundred and Fifty. Between William Rice of the county of and state of of the one part and the heirs general of John Brown Senr. deceased of the county of Elbert and State of Georgia of the other part. Witnesseth that for and in consideration for the sum of one Hundred dollars in hand paid the receipt whereof is hereby acknowledged the said William Rice hath granted bargained sold and conveyed and doth by these presents grant sell and convey unto the heirs general of the said John Brown Senr. deceased all that tract or parcel containing one hundred acres more or less lying and being in the counties of Elbert & Madison in the state of Georgia and adjoining lands belonging to John Dickerson the estate of the said John Brown Senr deceased and others. To have and to hold the said tract or parcel of land unto them the heirs general of the said John Brown Senr deceased their heirs and assigns together with all and Singular the rights incumben and appurtenances thereof to the same in any manner belonging to them and their own proper use benefit and behoof forever in fee Simple and the said William Rice for himself his heirs Executor and administrator the said bargained premises unto the said heirs general of John Brown Senr deceased their heirs and assigns will warrant and forever defend the right and title thereof against themselves and all persons claiming under them but against no other persons whatever. Georgia This Indenture made this thirteenth day of September Eighteen hundred and forty Elbert County four between John Brown Senr of the one part and Jacob Dilleshaw of the other part. Witnesseth that for and in consideration of the sum of One hundred and five dollars to him in hand paid the receipt whereof is hereby acknowledged. Hath granted bargained and sold and does by these presents grant bargain and sell unto the said Jacob Delleshaw all that tract or parcel of Land situated on Beaverdam Creek containing one hundred and five acres more or less it being part of a tract of Land granted to Robert Brown which lines is as follows (viz). Beginning at a sourwood on said tract joining Sarah Harbin's land thence down said creek to a Black Gum corner thence on Benjamin Winn's line to a Spanish Oak corner thence south east to a spanish oak corner on said Winn's line thence on said Winn's line to a pine corner thence on on Letty Haynes line to a pine stake corner thence to a pine corner thence on John Duncan's line to the beginning corner. The said John Brown doth warrant and forever define the above tract or parcel of land together with all and singular the rights members and appertenances thereunto belonging unto the said Jacob Dilleshaw his heirs and assigns forever in fee simple not only against myself my heirs and assigns but against all and every other person or persons whatever in fee simple.
