James Clarke died intestate. On 10 November 1719, administration on his estate was granted to Mrs. Abigail Clarke and Isaac Clarke, who presented an inventory acknowledging an 'estate in housing and land apprised at £280, which was given to the deceased James Clarke … half of which housing his mother, Mary Clarke, was to have ye use of during her natural life … and nothing in the inventory was to be taken to the prejudice of said Mary Clarke's right by virtue of the will of her late husband John Clarke, deceased.' An account on the estate of James Clarke, late of Norwich, deceased, was presented 13 December 1726, by Isaac Clarke. The distribution mentioned his widow and Relict, who received one third part of the real estate during her natural life, being £93-6s-8d, with one third of the personal estate forever. Only son James was given a double portion and two daughters (unnamed) were also given their portion of £58-8d each. On the same day the court appointed 'Barnet' Case of Windham to be the guardian of the three children of James Clark, namely: James, Abigail and Mary Clarke. Barnard Case shared bond in the amount of five hundred pounds with Pelatiah Fitch of Norwich for the faithful performance of his duty. On 1 March 1731/2, James Clarke, only son of James Clarke, late of Norwich, chose his uncle Pelatiah Fitch of Norwich, as his guardian. Bond of one hundred pounds was posted by [uncles] Pelatiah Fitch and Jabez Fitch."
