p. 38 WM. HORTON aged Sixty one yeares or thereabouts Subp: Sworne & Examined saith that ye Dept. Very well Remembers that sometime in July or Augt, 1660 to ye best of yor Depts. memory bee this Dept. and EDWARD CARY mett with Mr. HENRY BLAGRAVE at ye house of WM. NEWELL at the Middle Planton and there the sd CARY pcbased of ye sd Blagrave Six hundred acres of land lying on ye South side of POTOMACK CREEK for F'ourteene hundred pounds of Tobo &Caske and he this Deponent did then and there draw a Convey of the same in the Name of the said BLAGRAVE unto the sd CARY & JNO. AXTON and he this Depot_ was Surity with the sd CARY unto the sd BLAGRAVE for ye sd One thousand Five hundred and nine pounds of Tobo and the next Winter there came a Certificate unto this Depots. hand and the hand of Mr. FRANCIS KIRKMAN Clerke of ye Genii. Court that upon a Certaine day HENRY BLAGRAVE and MARY his Wife came into open Court and acknowd. ye Sale of ye sd Six hundred acres of hind unto ye sd CARY and AXTON and yor Dept. Very well knows that ye sd CARY & AXTON pd ye said Tobo and further saith not.

And further yor Dept. sayth that he this Dept, haxh heard that CAPT. DAVID MANSFIELID Father of the said MARY, did give the sd Land unto ye sd MARY but in wt, manor yor Dept_ knows not

The Depon of GERRARD LOWTHER of yee County aged thirty yeares or thereabouts sayeth that upon his Journey to JAMES TOWNE in Compa with Mr, THO GREGG of ye sd County & Mr, NELSON, this Depts_ with ye sd Compa went to ye house of one MR, HEARD who marry'd MARY Widdow & Relict of HENRY BLAGRAVE & Daughter of Capt. DAVID MANSFIELD where this Dept. & ye sd Mr. GREGG the sd NELSON entered into discourse with ye sd MARY concerneinge ye Sale of Six hundred acres of land situate & being on ye South side of POTTOMACK CREEKE in this ye sd County and sd MARY .... her sd husband BLAGRAVE to JNO. AXTON & EDW CARY late of ye sd County (part whereof is still in Question) MARY declared yet she & her sd Husband BLAGRAVE sold ye sd Six hundred acres of land to ye sd JOHN AXTON & EDWD. CARY & yt her sd husband did acknowledge the Deede of Sale thereof to AXTON & CARY at ye Genll. Court at JAMES TOWNE, and further declared yt for the sake of her said husband BLAGRAVE she would truely have parted wth all shee hade or words purporting ye same & further Deposeth that this Descourse was some few days after sd GOWRY had purchased ye sd Land & that she then further Declared yt ye sd GOWRY had cheated her Sone in Lawe & that he should not have the sd Land nor any other hereof ye sd AXTON & further deposeth not

JOHN AXOLL (Axton), 600 acs, Staff. Co.. S. side of Potomack Cr., 23 Sept. 1668, p. 174. On W'wd. side of Weepsiwasson Cr.. adj. Mr. Henry Meese, Mr. Wm. Horton. Mr. Willm. Haberd &c. Granted unto Capt. David Mansfield, who assigned & made over in marryage unto Mr. Henry Blagrove & Mary his wife, daughter of sd. David, who sold to Edward Cirey, dec'd.. & sd. Axton: & now due said Axton by survivorship.
