Last Will and Testament of Ezekiel DeWees

In the name of God Amen. I Ezekiel Dewese of the county of Guilford and the State of North Carolina being very weak in body, but of perfect mind and memory, thanks be given unto God’s calling into mind the mortality of my body and knowing that it is appointed for all men once to die do make constitute and ordain this my last will and testament and first and principally I recommend my soul into the hand of Almighty God that gave it and my body to the earth to be buried in decent Christian burial; nothing doubting but at the day of the general resurrection I shall receive the same again by the might power of God. As touching such worldly Estate as it hath pleased God to bless me with in this life, I give, demise, and dispose of in the following manner and form, viz.:

I give and bequeath to my well beloved wife Sarah one hundred and twenty five acres of land, including the plantation I now live on and occupy with all appurtenances thereunto belonging or in any wise appertaining to the same, by her freely to be possessed and enjoyed during her natural life and at her decease I will, give and bequeath the same to my well beloved son Caleb Dewese and his heirs and assigns forever upon this condition that he well and truly pays to my Executors hereafter named the sum of forty dollars to be divided equally amongst my heirs.

I also give and bequeath to my well beloved wife Sarah one horse from among my stock of which I desire her to have the right of choice and whichever she may choose I give and bequeath too her during her natural life, together with all the farming utensils, also two feather beds and furniture and as much other house and kitchen furniture as she may think proper to retain her hands and possession during her natural life, with one years provisions for her and all stock that she may choose and to hold possession of, for my will and meaning is that she shall have two cows of her choice among my cattle, and six such hogs as she may think proper to choose. I give to the heirs of my well beloved daughter Mary Simpson the sum of fifty dollars to be raised and levied out of my Estate, also give to the heirs of my well beloved daughter Susanah Aydtott the sum of fifty dollars to be raised in like manner. I also give and bequeath to my daughter Sarah Dilworth the like sum of ten shillings to be raised in like manner. I also give to my well beloved grandson Absalom Dilworth the sum of twelve dollars and fifty cents to be raised and levied out of my Estate, to be paid to him by my Executors when he shall arrive at the age of twenty one years. I also give and bequeath to each of my granddaughters, viz., Jane, Mary and Ann Dilworth the sum of twelve dollars and fifty cents to be raised and paid in the same manner, now my will and meaning is that if any of the aforementioned grandchildren should die before they arrive at the age of twenty one years, that my executors pay to those remaining the sum left to the deceased. And my will and meaning is that all just debts or claims on my Estate be punctually paid and satisfied by my Executors out of my estate, for which purpose I will order and ordain that they as soon after my decease as convenient make public sale of all my goods and chattels and movable effects, otherwise than what I have already disposed of together with a certain tract of parcel of land lying in the above mentioned county of Guilford purposed to contain about twenty one acres be the same more or less. And I also give and bequeath to each of my well beloved sons, viz., Joseph, Ezekiel, and Elijah Dewese, the sum of ten shillings to be paid to them out of my Estate.

And I further will and ordain, that after sale be made as above directed of the above named movable effects with land that if there is anything remaining on amount of sale after the above bequests and all of my just debts be satisfied that the balance be equally divided and distributed amongst my heirs above named.

And I do hereby nominate, constitute, appoint, and ordain my well beloved son Elijah Dewese and Abraham Peeples the sold executors of this my last will and testament. And I do hereby utterly revoke disannul and disallow all other wills legacies and bequest in anywise before named willed or bequeathed, ratifying and confirming this and no other to be my last will and testament, this 11th day of April 1821.
