I Daniel W Harkness of the Township of Raisin County of Lenawee and State of Michigan do make publish and declare this to be my last will and testatment.

My will is first that any funeral charges and just debts shall be paid by my executor hereinafter named.

The residue of My Estate which shall not be required for the payments of my just debts funeral charges and the expenses attending the execution of this my will and the administration of My Estate I give devise and dispose thereof as follows to wit: I give and devise to my beloved wife Sarah Ann Harkness one third of all my personal Estate.

My will is that my real Estate be sold and one third of the proceeds of the sale be paid to my beloved wife Sarah Ann Harkness by my executor hereinafter named to have and to hold to her and her heirs executors and administrators to her and their use and behest [??] forever.

My will is that the residue of my personal property be sold and the proceeds of sale and the Ballance of the proceeds of the sale of my real estate after settling with my wife Sarah Ann as above mentioned be put out to Interest and the said Interest be paid to my wife anually as long as she remains my widow.

In case of her Mariage or Death the principal and Interest to be paid to my lawful heirs.

My will is further that if my wife Sarah Ann Harkness remains My widow untill my child or children become of age or untill they are eighteen years old then the residue or remainder of my property that is left at that time be divided equally between my wife and children that are then living. And I do nominate and appoint Artemus J. Dean to be the sole executor of this my last will and testament.

In testimony whereof I the said Daniel W. Harkness have hereunto subscribed my name and affixed my seal this second day of December of December A D 1850.

Excerpts from executor's petition, dated 16 Dec 1850, from Lenawee County Probate Records, Microfilm Reel 807, File 630.

To The Hon. Consider A. Stacy Judge of Probate for the County of Lenawee in the State of Michigan:

The petition of Artemus J. Dean who is of the age of twenty-one years and upwards, of the County of Lenawee, respectfully shows:

That Daniel W. Harkness late of Raisin in said county of Lenawee departed this life in said town of Raisin on Friday the Sixth day of December in the year of our Lord one thousand eight hundred and fifty --- first making a last Will and Testament, as your petitioner is informed and verily believes. Which said last Will & Testament is herewith filed and by which your petition was appointed Executor.

That said deceased was, at and immediately previous to his death, an inhabitant of said County of Lenawee and that he was then possessed of real & personal Estate, situate and being in the County of Lenawee & Ingham to be administered, and that the estimated value thereof in the sum of one thousand dollars or thereabout, as your petitioner is informed and verily believes.

And your petitioner further shows that the names and residences of the heirs at law of said deceased, and other person interested in his Estate, are as follows: Mariam Harkness and an infant and Sarah Ann Harkness Widow, all of whom live in said town of Raisin.
