Partition. Andrew Jackson Adkinson vs. Nelson Smith, et al. Filed 7 Mar 1848 by Fin L. Maddox, stating Collins Smith died 1840 the owner of 200A. in Sect 31 Twnshp 21 Range 7 and other lands which were sold to pay his debts. Left heirs: Nelson, Hoel, Hayden, Dexter, Silas, William, & Elsey Smith; William S. Johnson & Polly (Smith?) Johnson -- all adults. Also, Lysander, Orlando. Mary M., Laura, & Melissa Smith, infants. And Nancy Smith, widow. Adkinson claimed he owned one share by deed from Nelson Smith. Notice was given Hoel, Dexter, Hayden, Silas, & the Johnsons, all of them non-residents. Avery D. Babcock appointed guardian ad litem of the minors. Wesley T. Walker was made an additional defendant & waived process. Silas, William, & Dexter Smith, "by Mallory", denied they received "an advencement by their ancestor in his lifetime," but that Hoel & Hayden each had received $500, and Nelson had received $143, which should be taken into consideration in the partition. They denied Adkinson had any title to any portion by purchase or otherwise, but that Wesley T. Walker owned the share of the Johnsons. Joseph Coats, Joseph Glascock, & Joseph Lucas, Commissioners, made partition.

Petition to Sell. Joseph Glascock, administrator of the estate of Collins Smith, dec'd, vs. the heirs. Petition (filed 11 May 1848) states that Collins Smith left as his heirs Hoel (Hoyle), Dexter, & Hayden Smith; Polly Smith, since married to William S. Johnson -- all adult & non-resident. Also, Nelson, William, Lysander, Silas, Orlando, & Elsey Smith, resident adults. Also, Mary M. Laura, & Melissa Smith, resident minors. Notice placed in the PEOPLE'S FRIEND for sale of 40A. in S31 T20 R7, appraised by Aaron Applegate & Isaac N. Spinning. Charles Tyler appeared as guardian ad litem for the three minor heirs. Joseph Glascock gave bond with George Glascock. Administrator made deed to John Dice.
