Audrey Savage, who after being duly sworn according to law, states as follows:
That on or about Sunday, May 20, 1956, I visited the cemetery known as Moore Graveyard, which is located about two miles south of the town of Pocahontas in the southeast corner of Hardeman County, Tennessee, near the sight of the old village of "Matamora" and that near the center of said cemetery is to be found a long white marble tablet upon which the following words appear:

TO THE WORSHIPFUL COUNTY COURT OF HARDEMAN COUNTY:
Your petitioners, Elizabeth Robertson, J. M. C. Robertson, by his attorney, A. T. Robertson, A. T. Robertson, William Jones and Naomy Jones his wife, Joseph R. Robertson, Theophilus S. Robertson and J. C. N. Robertson, Jr., a minor under 21 years of age by his regular guardian, Elizabeth Robertson, would respectfully represent unto Your Worships that CHARLES ROBERTSON departed this life in said County intestate sometime in the year 1842, leaving the following heirs and distributees, to-wit:
Elizabeth Robertson, widow and relict of said deceased, William R. Robertson, John M. C. Robertson, A. T. Robertson, William Jones and Naomy Jones his wife, Joseph R. Robertson, Theophilus S. Robertson, Patrick F. Robertson, Charles S. Robertson and Julius C. N. Robertson, Junior. That letters of administration has been granted to Joseph R. Robertson who has proceeded to pay off all the debts of said deceased, and etc.; that said deceased died seized and possessed of the following negro slaves, to wit: Soo and her children, May and Martha and Caroline; that soon afterwards had two other children now living, that Soo and Caroline are dead but that her four children, Mary, Martha, Jenny and Buck are still living; that all the heirs are of mature age except Julius C. N. Robertson, Jr.; that he is about nineteen years of age and Is in need of a portion of his interest in said slaves to pay for tuition, etc; That the other heirs are desirous for a distribution of said slaves and that the same cannot be made without a sale. Your petitioners would further shown unto Your Worships that the said Elizabeth Robertson, widow as aforesaid, has never had her interest in said slaves allotted to her but desires them sold and her share paid to her of the proceeds of said sale, and that the said A. T. Robertson is the owner of the several interests of W. R. P. F. and C. S. Robertson.
The premises Considered, your petitioners pray Your Worships that by decree of Your Worshipful Court said slaves may be sold and that R. P. Neely, Clerk, be appointed Commissioner to sell the same and that the proceeds after giving ten days notice of the time and place of said sale to sell said slaves on a credit of twelve months taking bond and security for the purchase money and report to the next term of this Court.

Final Decree, dated January 6, 1860, appears in the minutes of that date in Minute Book No. 10 of said County Court.
A portion of the final decree showing the heirs and distributees of Charles Robertson, follows:
.......... "It is ordered, adjudged, and decreed by the Court that all the title, interest and claim which the said Elizabeth Robertson, Wm. R. Robertson, J. M. C. Robertson, A. T. Robertson William Jones and Naomi Jones, his wife, Joseph R. Robertson, Theophilus S. Robertson, P. F. Robertson, Chas. S. Robertson and J. C. N. Robertson, Jr., as heirs and distributees of CHARLES ROBERTSON, deceased, have in and to said lots be divested and vested in Hendley Stone, his heirs and representatives forever."

I, W. J. Savage, Jr., a Notary Public in and for said County and State, hereby certify that the foregoing Petltion to Divide Slaves is a full, true and complete copy of the petition in Cause No. 99 R. D., County Court of Hardeman County, Tennessee; that the quoted portion of the Decree in said Cause No, 99 R. D. is true and correct; that the quoted portion of the Decree in said Cause No. 106 R. D., County Court of Hardeman County, Tennesnee, is likewise true and. correct, and that said court proceedings are found in the office of the County Court Clerk of Hardeman County, Tennesses, in the minute books of that Court and in the origlnal files of said Causes.

To the worshipful County Court of Hardeman County your petitioners Elizabeth Robertson JMC Robertson by his attorney A.T. Robertson, A.T. Robertson, William Jones and Naomy Jones his wife, Jos. R Robertson, Theophulus S. Robertson and JCN Robertson a minor under 21 years of age by his regular guardian respectfully repocsent (sic) unto your Worship that Charles Robertson departed this life in said County intestate sometime in the year 1842, leaving the following heirs and distributees towit: Elizabeth Robertson, Widow and relict of said deceased, Wm R Robertson, JMC Robertson, A.T. Robertson, William Jones and Naomy Jones, his wife, Jos R Robertson, Theophulis S. Robertson, Patrick F Robertson, Charles S. That the other heirs are desirous for a distribution of said slaves, and that the same can not be made without a sale. Your petitioners would further show unto your worship that the said Elizabeth Robertson widow as aforesaid has never had her interest alotted to her but desires them sold and her share paid to her of the proceeds of said sale, and that the said A.T. Robertson is the owner of the several interests of W.R. P.F. & CS Robertson.
The premises considered, your petitioners pray your worship that by a decree of your worshipful Court said slaves may be sold and that RP Neely, Clerk, be appointed Commissioner to sell the same, and that he proceed after giving ten days notice of the time and place of said sale, to sell said slaves on a credit of twelve months taking bond and security for the purchase mony and report to the next term of this court.

DECREE FOR SALE OF SLAVES
Be it remembered that on this the 3rd day of January AD 1854 came on this cause to be heard before the worshipful county court of Hardeman County upon complainants petition and it appearing to the court that Charles Robertson is dead that administration has been made upon all & singular his goods, chattels &c & his debts all paid and that the slaves in said petition mentioned (viz) Mary Martha Jenny & Buck belong to the estate of said deceased that all of the distributees of said estate are of full age except JCN Robertson Jr & that is necessary for the protection of his interest for said slaves to be sold & that all the parties in interest are properly before the court. It is therefore ordered adjudged & decreed by the court that said slaves Mary Martha Jenny & Buck be sold & that RP Neely Clerk be appointed commissioner to sell the same & that he proceed after giving ten days notice of the time & place of said sale in writing posted up in three or more public places in said County of Hardeman to sell said slaves on a credit of twelve months at public auction to the highest bidder at the house of Elizabeth Robertson at Matamoras in said County of Hardeman taking bond & approved security for the purchase money & report to the next term of this court.
DECREE OF TITLE &C
Be it remembered that on this the 8th day of February 1854 came on this cause for further hearing before the Worshipful county Court of Hardeman County upon Complainants petition & report of the Clerk & Master which report is in the words and figures following (to wit) the undersigned C & M appointed at the January term 1854 of this court to sell the slaves in said petition mentioned respectfully reports that pursuant to said interlocutionary decree after advertising the time & place of Sale as therein directed he proceeded to sell said slaves in said petition mentioned belonging to the estate of Charles Robertson decd at the house of Mrs Elizabeth Robertson at the town of Matamora in said county at public auction to the highest bidder on a credit of twelve months & that he sold girl Mary & the girl Martha in said petition mentioned for the sum of eleven hundred & twenty five dollars ($1125.00) for Mary & eleven hundred & fifty one dollars for Martha he being the highest & best bidder for the same & have taken his notes for said sum of twenty two hundred & seventy six dollars due 12 months after date & dated 23rd day of January 1854 with TS Robertson & Elizabeth Robertson as his security the clerk & master further reports that he sold the girl Jenny in said petition mentioned to William Jones for the sum of nine hundred & seventy nine dollars & fifty cents & took his note due 12 months after date & dated 23rd of January 1854 with Sampson Carper & Ephraim H Park as his security that he sold the boy Buck to Theophilus S Robertson for the sum of five hundred dollars for which he took his note due 12 months after date & dated 23rd day of January 1854 said sale amounting in all to thirty seven hundred & 75 & 50/100 dollars ($3775.50) the clerk & master is of opinion that one hundred dollars of said sum will be sufficient to pay the expenses of said sale & if as there being ten legatees there would be the sum of three hundred & sixty seven dollars & 55 cts of the proceeds of said sale going to each legatee. The Clerk & Master would further report that A.T. Robertson is one of said distributees, that he has a legal transfer of the several interests of William R Robertson Joseph R Robertson Patric F Robertson & Charles S Robertson legatees of said estate in the proceeds of said sale which would entitle [line or lines missing from copy] ...upon his said note that Theophilus S Robertson is entitled to a credit of three hundred & sixty seven dollars & fifty five cents on his note for his distributive share in said sale & that the note of William Jones will be entitled to a credit of three hundred & sixty seven dollars & fifty five cents for the distributive share of the said Naomy Jones upon her acknowledging the same in court &c all of which is respectfully submitted

and no exceptions being taken to said report the cause in all things confirmed & it appearing to the satisfaction of the Court from said report that the slaves mentioned in said petition were sold pursuant to our interlocutionary decree in this cause at the January term of this court that the slaves Mary & Martha were stricken off to A.T. Robertson he being the highest & best bidder for the sum of twenty two hyndred & seventy six dollars that William Jones became the purchaser of the girl Jenny for the sum of nine hundred & ninety nine & 50/100 dollars. That Theophilus S Robertson became the purchaser of the boy Buck for the sum of five hundred dollars. It further appearing to the court that A.T. Robertson has an interest in one tenth part of the proceeds of said sale & that he has also a legal transfer of the several interests of William R Robertson JR Robertson Patric F Robertson & Charles S Robertson & that he is entitled for his several said shares to a credit of the sum of eighteen hundred & thirty seven dollars & 75 cents upon his note executed for said slaves Mary & Martha & that Theophilus S Robertson is entitled to a credit of three hundred & sixty seven dollars & 55 cts upon his said note & that William Jones & Naoma Jones are entitled to the sum of three hundred & sixty seven 55/100 dollars of.the proceeds of said sale. It further appearing that Elizabeth Robertson is the widow & relict of said Charles Robertson decd. & that her interest in said slaves has not been laid off & allotted to her & that she & the other petitioners in said cause were desirous for her to have her part of the proceeds of said sale. It is ordered adjudged & decreed by the court that all the right title claim & interest which the said Elizabeth Robertson widow as aforesaid William R Robertson John MC Robertson William Jones & Naoma Jones his wife Joseph R Robertson Theophilus S Robertson Patric F Robertson Charles S Robertson & Julius CN Robertson Jr have in & to the slaves Mary & Martha as heirs and distributees of Charles Robertson decd in said petition & report mentioned be divested out of them & be & the same is hereby vested in Alexander T Robertson his heirs & assigns forever. It is further ordered adjudged & decreed by the court that all the right title claim & interest which the said Elizabeth Robertson William R ,Robertson John MC Robertson AT Robertson Joseph R Robertson Theophilus S Robertson Patric F Robertson Charles S Robertson & JCN Robertson Jr have in & to the slave Jenny in said petition mentioned as heirs & distributees of Charles Robertson decd. be divested out of them & be & the same is hereby vested in William Jones the purchaser & his heirs and assigns forever.
It is further ordered adjudged & decreed by the court that all the right title claim & interest which the said Elizabeth Robertson William R Robertson John MC Robertson AT Robertson Joseph R Robertson Patric F Robertson Charles S Robertson & JCN Robertson Jr have in & to the boy Buck be divested out of them & be & the same is hereby vested in Theophilus S Robertson His heirs & assigns forever.
It is further ordered by the court adjudged & decreed that Elizabeth Robertson be entitled to receive the one tenth part after deducting the costs of this cause of the proceeds of said sale of said slaves for her distributive share therein. It is further ordered adjudged & decreed by the court that RP Neely clerk of this court be authorized to write a credit of the sum of eighteen hundred & thirty seven dollars & 75 cts upon the note of AT Robertson for the several interests herein before recited belonging to him in the proceeds of said sale upon his filing his receipt therefor with said clerk.
It is further ordered adjudged & decreed by the court that the said clerk be authorized to enter a credit of three hundred & sixty seven 55/100 dollars upon the note of TS Robertson upon his filing his receipt for his distributive share in the proceeds of said sale. It is further ordered by the court that said clerk be authorized to enter a credit of three hundred & sixty seven 55/100 dollars upon William Jones note for the slave purchased by him for the distributive share of said Naoma Jones in said sale upon his filing his receipt therefor & that Naomy giving her assent thereto as the law requires.
On this the 6th day of April 1855 this cause came on for further hearing before the worshipful county court of Hardeman County upon the report of the Clerk & Master & exhibits in the cause which report is in the words & figures following (to wit) In this cause I beg leave to report to this worshipful court that I have recd. of William Jones the sum of three hundred & sixty dollars in cash and the sum of one hundred & twenty dollars & fifty five cents in the receipt of Elizabeth Robertson to said William Jones which is received as cash & have the sum now on hand subject to the order of this court all of which is respectfully submitted.
