    "1. Benjamin1 Nye arrived in Massachusetts Bay Colony before 10 December 1635 and died between 9 June 1704 and 17 May 1707, probably at Sandwich, Massachusetts. He married at Sandwich on 19 October 1640, Katherine2 Tupper. According to a Tupper genealogy, Katherine Tupper, was born '31 January 1623' in England, daughter of Thomas1 Tupper, born '27 (28) Jan 1578 in Bury, Sussex Co., England' and his first wife Katherine Gator whom he married '29 Apr 1622 in Chelmsford, Essex Co., England,' all of which is doubtful. Katherine died after 9 June 1704 when she was mentioned in Benjamin1 Nye's testamentary deed. No death record or gravestone has been found for either Katherine or Benjamin and no New England record yet discovered provides an indication of their ages — and hence an approximation of their birth years which might in turn confirm baptismal dates in England."

    To all people to whome these presents shall come Benjamin Nye of the Town of Sandwich in the County of Barnstable in New England Sendeth greeting &c.   9. Most genealogies of Benjamin Nye seem to be based on A Genealogy of the Nye Family (1907), edited by David F. Nye, compiled by George H. Nye and Frank E. Best. More recent research has cast doubt on Benjamin's parentage and place of origin in England. Further research in England may, but is not likely to, confirm the identity of his parents. A cursory review indicates that information in the Nye genealogy concerning the time subsequent to Benjamin's arrival in Sandwich is more reliable.
  10. The compilers interpret this deed to indicate that Benjamin Nye died on 30 April 1714. One would need to see the complete deed (or a detailed abstract) before accepting that conclusion.
