    Will Probate and Bond


    In the name of God Amen, the twenty third Day of January, Annoque Dominie 1771, I Benjamin Herrick of Methuen in the County of Essex in the Province of Massachusetts Bay in New England, Gentleman, being sick and weak in Body, yet blessed be God of perfect Mind and Memory, and calling to Mind the Mortality of my Body, Do make and ordain this my last Will and Testament that is to say, Principally I give and recommend my Soul into the Hands of God that made it, and my Body I recommend to the Earth to be buried in decent Christian Burial at the Discretion of my Executors here after named with full assurance that at the general Resurrection I shall receive the same again by the mighty Power of God: ---- And as touching such worldly Estate wherewith it hath pleased the Lord to less me in this World I give and dispose of the same in the following Manner and Form.

    Imprimis I will and order that all such Debts as I owe at the Time of my Decease and my funeral Charges and Legacies hereafter mentioned be seasonably paid by my Executors hereafter named.

    Item I give to my beloved Wife Lydia Herrick all my household goods, and all my Provisions, of all sorts for Eating and Drinking. ---- And having already given Portions to all my children according to my ability and yet in regard of my Parental Love to them.

    Item I give to my beloved son Israel Herrick one Shilling lawful money.

    Item I give to my beloved grandson Benjamin Herrick, son of my son Edward Herrick dec'd ten shilling lawful money. ____

    Item I give to my beloved son Benjamin Herrick Jun'r all my wearing apparel.

    Item I give to my beloved son Nathaniel Herrick one shilling lawful money.

    Item I give unto my beloved Daughter Lydia Dodge one shilling lawful money.

    Item I give unto my beloved Daughter Hannah Whittier one shilling lawful money.

    Item I give all the rest of my Estate to my two beloved sons, namely, Ebenzer Herrick and Thomas Herrick and to their Heirs and assigns even all the Estate which I have or shall have at the Time of my Decease which is not herein before disposed of. I give the whole thereof to my said son Ebenezer Herrick and Thomas Herrick whom I likewise constitute and appoint my joint Executors of this my last Will and Testament hereby disannulling and revoking all former wills and testaments by me heretofore made and confirming this and this only this to be my last will and testament. In testimony whereof I have here unto set my hand and seal the day and year above said.

    Seal To all People to whom these Presents shall come, Benj'm Herrick Lynde Esq, Judge of the Probate of Wills, etc. in the county of Essex within the Province of Massachusetts Bay in New England sendeth Greeting-----

    Know ye, That on the twenty fifth Day of October Amno Domini `1773 the Instrument hereto annexed purporting the last Will and Testament of Benj'm Herrick later of Methuen in said County, Gentleman, deceased, was presented for Probate by Ebenezer Herrick and Thomas Herrick the Executors therein named; Then present Nathaniel Messer jun'r and Asa Messer Witnesses thereto subscribed, who made Oath, that they saw the said Testator sign, seal and heard him declare the said Instrument to be his last Will and Testament and that they with Ebenezer Barker subscribed their Names together in Witness to the Execution thereof in the said Testator's Presence, and that he was then (to the best of their Judgment) of sound and disposing mind.----

    I do prove, Approve and Allow of the said Instrument as the last Will and Testament of the beforenamed decease, and do commit the Administration thereof in all Matters the same concerning, and of his Estate whereof he died said and possess'd in said county unto Eben'n Herrick and Thomas Herrick the before named Executors well and faithfully to execute the said Will and to administer the Estate of the said deceased according thereto; who accepted of their said Trust, and gave Bond to pay all the Debts, legacies and fulfil his Will, and they shall render and Acco't (upon Oath) of Proceedings, when thereunto lawfully required. And Lydia Herrick widow of said dec'd signified her Acceptance of what is given her in said dec'd Will in Lien of her Dower. In Testimony whereof, I have hereunto set my Hand and Seal of Office, the Day and Year above written.

    Essex is: Eben'r Herrick and Thomas Herrick Ex'orsto the last Will and Testament of Benj'm Herrick late of Methuen Dec'd gave Bond with Nath'l Messer jun'r as Sureties to pay the said Dec'd Debts and Legacies and to fulfill his Will.
