    Mr. Hakes' maternal grandfather was Anthony Eymer, who was born in Germany and came to America as cabin boy in the fleet of Gen. John Burgoyne, in 1775, remaining in America after the surrender. He married in Connecticut and removed to Rensselaer county, N. Y., where he resided until his death in 1826.

    The People of the State of New York by the Grace of God Free and Independent: To all whom these presents shall come or may concern send Greeting: Know Ye that at the City of Troy in the County of Rensselaer on the twenty third day of April in the Year of our Lord one thousand eight hundren and twenty seven before Thomas Clowes esquire, surrogate of our said county the last will and testament of Anthony Eymer late of the town of Berlin in the County of Rensselaer, State of New York deceased decreed[??] (a copy of whereof is thereunto annexed) was proved, and is now approved and allowed by us; and the said deceased having whilst he lived and at the time of his death, goods, chattel or credits within this State (by means whereof the proving of registering the same will, and the granting administration of all and singular the said goods chattels and credits and also the auditing, allowing of final discharging the account thereto belong to us) the administration of all and singular the goods, chattels & credits of the said deceased and anyway concerning said will is granted unto David Eymer executor in the said will named he being duly duly sword well & faithfully to administer the same and to & exhibit a true and perfect inventory of all and singular the said goods, chattels, and credits and also to render a just & true account thereof when thereunto required. In testimony whereof we have caused the seal of office of our said surogate to be hereunto affixed. Witness. Thomas Clowes Esquire surrogate of the said county at the city of Troy the twenty third day of April in the year of our Lord one thousand eight hundred and twenty seven.

    In the name of God. Amen. I, Anthony Eymer of the Town of Berlin, County of Rensselaer and State of New York. Considering the uncertainty of this mortal life being of sound mind blessed by the Almighty God for the same do make and publish my last will and testament in manner and form that is to say. First I do recommend my spirit into the hands that gave it one, and my body to the grave. Then I give and bequeath to my son Peter Eymer the sum of one dollar. I also give and bequeath to my daughter Sally Parks one cow and seven dollars. I also give and bequeath to my daughter Polly Hakes one cow and I also give and bequeath to my daughter Caroline Hakes deceased to her children: Parmela Hakes three dollars in money, and to Rensselaer Hakes Junr. [??] three dollars, and to Esther Hakes three dollars, and to Anthony Hakes three dollars and to Hanson Hakes three dollars, and to Daniel Hakes three dollars to be paid to them as they become of age. And to my daughter Ann Clow one cow and eight dollars in money and to my daughter Peggy Steward one dollar. Lastly as to all the rest residue and remainder of my personal estate goods and chattels, lands & tenements of kind & nature soever I give and devise to my son David Eymer his heirs & assigns forever. Which said several legacies and sums of money I will and ordain shall be paid to the said respective legators within six months after my decease to be paid to by David Eymer together with all my debts and funeral charges of myself. And finally I make and ordain David Eymer my son sole executor of this my last will and testament hereby revoking all former wills by me made. Witness whereof I have unto set my hand and seal this twenty sixt day of March in the year of our Lord one thousand eight hundred and twenty seven. Signed, sealed, published & delivered by the above named Anthony Eymer to be his last will and testament in the presents of us who have hereunto subscribed our named as witnesses in the presence of the Testator.

    State of New York, Rensselaer County SS: Be it remembered that on the twenty third day of April in the year of our Lord one thousand eight hundred and twenty seven personally appeared before me, Thomas Clowes esquire surrogate of the said county of Rensselaer, Richard Mentor & Abel Rhodes two of the subscribing witnesses of the will of Anthony Eymer late of the town of Berlin in said county deceased; who being duly sworn declared that they did see the said Anthony seal and execute the annexed written instrument purporting to be the last will and testament of the said Anthony, bearing date the twenty sixth day of March in the year of our Lord one thousand eight hundred & twenty seven and heard him publish and declare the same as & for his last will and testament; that at the time thereof he the said Anthony was of sound disposing mind and memory to the best of the knowledget and belief of the said Richard & Abel and that they the said Richard & Abel together with Alvin Mentor the other witness to the said will severally subscribed their hands & named to the said will, as witnesses thereto in the presence of the testator and each other.

    In testimony whereof the said surrogate hath hereto set his hand and affixed the seal of his office at the city of Troy the day and year aforesaid.
