Will of Andrew Woods

State of Kentucky
I Andrew Woods of the state aforesaid and County Mercer, being weak in body but of perfect mind and memory and calling to mind the mortality of living do Ordain and Establish this to be my last will and testimony.
In the first place I commend my soul to god, into the hands of Almighty God who gave it and my body to be decently buried by my executor to be hereafter named.
Secondly it is my will and desire that alll my just debts be first paid by my executor out of my personal estate.
Thirdly it is my will and desire that my farming utensils and kitchen furniture together with the plantation I now live on be for the use of my wife during her widowhood for the purpose of Raising and Supporting all my children but in the case she shall marry and move off the plantation then she shall only have third of the property of the land. The balance shall go to my children Equally. But in case my wife does not marry then I leave my plantation to her and the children, which shall be living during her life. But my children shall each at their respective ages of twenty one have a Right to receive their Equal Share together with my wife of the rents and profits of the plantation due my wife at all events if she continues single shall have a right to live in the house and use the kitchen furniture during her life. And in case my wife should marry and live on the plantation then she is only in the same manner to have her third of everything.
4th It is my desire that my wife shall have my Negro girl Beck during the life of my daughter Polly in case my wife should live single to have her during her own life to support herself and my children whilst they live with her but in case she marrys again then said Negro girl is to be hired out and the money equally divided amongst my surviving children but of my wife I have, live through during her life then she shall not be sold till after her death, then the money to be disposed as above.
Fifthly it is my will that all moneys or property which now is or which shall hereafter be due by bond note or book account or which shall arise from the sale of all my out lands which I authorize my executor to make sale of and make the titles to the same shall when collected be paid to my children at their respective ages of twenty one or marriage which ever happening first and to my wife who shall have an equal part with them viz a child's part. As to the land I live on it shall be sold at my wife's death and the money divided among my living children at their ages above named if her death should happen before but if not then as can be collected.
Sixthly as to my household property and stock of all kinds and other personal property not before disposed of. It is my will that my executors make sale of only such part as they think proper and shall have the right to reserve as much of it as they think, keeping which shall go to the use of my family who shall have such portions of it as their ages of twenty one or marriage as my executors think Proper not exceeding an equal part with the remaining part of my family.
Seventhly as to all my boys it is my will that their legal guardian shall put them to proper trades at which ever age he or she thinks proper after fourteen.
Eightly it is my will and I do hereby vest my executors with full powers to make conveyances of any tract of land which I now stand bound to make a title to my bond.
Ninthly the money arising from the sale of my property and stock not reserved by my executors shall be disposed of in the same manner as the money arising from the sales of my own lands to my wife and children as before.
Tenthly lastly I do hereby appoint my friends James McGee, Robert B. McAfee, my brother Archibald Woods and my wife executors of this my last will and testament. In testimony whereof I have herein to set my hand. I seal this 7th day of August 1806.

The foregoing last will and testament of Andrew Woods, deceased was produced into court and proven by the oaths of R. B. McAfee, Matthew Forsythe, two subscribing witnesses which whereupon I have made the same record.

    Notes for ANDREW WOODS:
    It is believed that Andrew is one of the older children as the oldest son, James, gave him power of attorney to sell their father, Archibald's property in Botetourt after his death, since he, James, was already in Kentucky in 1787, although Archibald, John and Joseph were also in Virginia.Also, Mary lists Archibald, son of Andrew, fifth in line in her will - after Archibald, son of James, Archibald son of Thomas, Archibald Adams, Archibald Ward.Also, 1760 is the date Neader M. Woods gave for the date of the birth of the Andrew (son of Archibald d. 1783) that he attributed to Archibald son of 'Michael of Blair Park', although Archibald and Isabella did not have a son Andrew.
    Andrew's will was written August 7, 1806 and was probated October County Court 1818.Mercer County, Kentucky.Will Bk. 6 - pages 126, 127 and 128.
