"Leominster - Saturday night, the peace and quiet of the citizens living in the vicinity of Water Street was disturbed by the noise of a party of revelers in the upstairs room at the rear of the barber shop, owned by Moses Miller. The police were notified that all was not as it should be. They succeeded in quieting the noise, but still kept watch of the place. At about 5:30 a.m.today, Officer Corkum with the necessary papers, gained and entrance and found James J. Burns, better known as "Smiley Burns" occupying the same apartment with a woman who gave her name as Addie Wardwell, and claimed Lowell as her place of residence. Burns had been connected with affairs of this kind before. He was brought before Judge Bascom at 8 a.m. and pled guilty to the charge of adultery, the original charge of fornication having been changed upon the admission of the Wardwell woman that she was married. Burns was ordered to recognize in the sum of $500 for his appearance at the Superior Court in Worcester, the second Monday in January. He secured bail. A hearing will be given the Wardwell woman at 2 p.m. today." - The Fitchburg Sentinel 09 November 1896
