In the Name of God, Amen . I, David Martin of Fairfield County, State of Ohio, being [weak e ] in body but of sound and perfect mind and memory, blessed be [almity] God for the same d o m ake and publish this my last will and testament in the manner and form following (that i s t o say) first I give and bequeath unto my beloved wife, Jean Martin, all my personal estat e go ods and [---] of what kind and nature [foever] except the old [m---] which belongs to m y son , Ellison Martin. I also allow all my lands to be sold to the best advantage at the dis cretio n of the executor's of this my last will and testament as soon as convenient after m y deceas e and after defraying all necessary expences. Thereby give and bequeath to my two so ns, Eliso n Martin & James Martin all the remainder of the piece of said lands they paying th e followin g [legasies] and remaining in the family [capacyty] until they [arive] at the ag e of twenty-o ne years each and if either of them die or otherwise [ob---] the family befor e that age thei r share to devolve back to be divided equally among the rest of the legalie s according to eac h ones proportion their legacyes to be layed out upon land at the discreti on of my executor s if it be obtained during the minority and first I give and bequeath to m y Daughter Grizel B rooks the sum of one dollar, next I do give and bequeath to my Son Willia m Martin the sum o f one dollar, next I do give and bequeath to my Son Josiah Martin the su m of one Dollar, nex t I do give and bequeath to my Daughter Isabel Hardy one Dollar, nex t I do give and bequeat h to my Son Joseph Martin the sum of one Dollar, next I do give and b equeath to my Son Davi d Martin the sum of Sixty Dollars, next I do give and bequeath to my D aughters Jean Martin th e sum of Sixty Dollars, next I do give and bequeath to my Son Charle s Martin the sum of Sixt y Dollars and to be put to a trade at the age of fifteen years and t o be under the guardiansh ip of Charles McClung, next I do give and bequeath to my Son Joh n M. Martin the sum of Sixt y Dollars and also to be put to a trade at the age of fifteen ye ars to be under the guardians hip of John McMeen, next I do give and bequeath to my Daughte r Margret Martin the sum of Sixt y Dollars to be under the guardianship of Charles & Margre t McClung provided that their Mothe r should die or change her way of living and become no mo re my Widow. Next I do give and bequ eath to my Son Robert M. Martin the sum of Sixty Dollar s to be put to a trade at the age of f ifteen to be under the guardianship of William Martin . All these Minor Children from David do wnwards to have schooling free of their legacyes a s God in his providence may give [oportunit y] and ability I do here by appoint Charles McClu ng, John McMeen and William Martin executor s of this my last will and testament hereby revok ing all former wills by me made in witness w hereof I have hereunto set my hand this twenty-e ight day of Sept. in the year of our Lord on e thousand eight hundred and fou r .[signed] Dav id Martin
