Dated 13th November 1917 This is the last will and testament of me John Ebbott of Chewton in the State of Victoria Gentleman I appoint John Ebbott of 44 Ebden Street Elsternwick in the said State Commercial Traveller and my son Gilbert Henry Ebbott usually of 34 Wigton Street Ascot Vale in the said State Painter but now of France Soldier (hereafter called my Trustees) to be Executors and Trustees of this my Will I give and Devise and bequeath all my real and personal estate whatsoever and wheresoever unto my Trustees Upon the following trusts that is to say As to my book case Upon Trust for my said son Gilbert Henry Ebbott and so to all other part or parts of my household furniture and all my articles of household or domestic or ornament upon trust for my wife Isabella Ebbott for her own use and benefit during her life and after her death upon trust for my children equally to be divided among them as they may mutually agree As to my property in Church and George Streets Chewton being Crown Allotment Seventy Three and part of Crown Allotment Seventy Four Section F One Parish of Chewton County of Talbot and all buildings erected thereon and all the land used by me in connection therewith Upon Trust to allow my said wife the free use and occupation thereof during her life and after her death the same shall fall into and form part of residuary estate and as to all the rest residue and remainder of my real and personal estate (hereinafter called my residuary) Upon Trust to sell call in and convert into money all such parts thereof as shall not consist of money and to stand possessed of the proceeds of such sasle calling and conversion of all moneys in my estate Upon Trust to pay my debts funeral and testamentary expenses and Probate Duty and to invest the balance of such proceeds and to pay out of the Corpus of income of my estate the sum of Ten shillings per week to my wife during her life and AFTER the death of my wife Upon Trust to divide the balance then remaining between all my children who shall survive me and attain the age to Twenty one years Provided that if any child of mine shall die in my lifetime leaving issue who shall survive me and attain the age of twenty one years such issue shall take and if more htan one equally between them the share which his her or their parent would have taken in my estate if such parent had survived me and attained a vested interest And Lastly I revoke all former Wills and testamentary depositions heretofore made by me and declare this to be my last Will and Tesament in Witness whereof I have hereunto set my hand this thirteenth day of November Oned thousand nine hundred and seventeen.
