Will & Testament of Dame Sarah Geer wife of Samuel Rollins of Shefford, 19 Nov. 1869

On this day, the nineteenth of the month of November, in the fore noon, in the year of our Lord one thousand eight hundred and sixty nine, before Thomas Brassard, undersigned Notary Public duly commissioned and sworn in and for the Province of Quebec, in the Dominion of Canada, residing in the District of Bedford, in the Province, and witness Robert Hill saddler & Augustus Noel gentleman, both of the village of Waterloo in the said District the undersigned witnesses called for the purposes and effects hereof.

Came and appeared Dame Sarah Geer actual wife of Mr. Samuel Rollins, of the Township and County of Shefford, in the said District farmer, in good health of body and of a sound and composed mind, memory and judgement as appeared to us the said Notary and witnesses & who being desirous of settling and adjusting her worldly affairs and in the view of death, of disposing of the property wherewith it has pleased the Almighty God to bless her, hers requested us the said Notary, to receive her last will and testament which she has named & dictated to us, the said Notary, writing the same as dictated, presence of the said witnesses, word for word and in the form and manner following, to wit:

1. I recommend my Soul immortal to God Almighty, and I commit my body to the grave to be therein interred in a Christian like manner.

2. I will, order and require that a tomb stone be placed on my grave and all my just and lawful debts paid and acquitted, within the year following the day of my decease, by my testamentary executors hereinafter named.

3. I give, devise and bequeath to my only three daughters, born of my marriage with my present husband, to each of them to wit: to Annis wife of James Blampin, Sarah actual wife of George Kimpton now in the United States of America, and to Suzanna Rollins actual wife of William J. Wallace, to each of them, the sum of one hundred dollars, to be paid out of my property and estate, by my said testamentary executor, within the year following the day of my decease, to my said daughters, or their heirs and assigns, as their share and portion in my future estate & succession, hereby substituting my said above named daughters my particular legatees.

4 and lastly. As to the rest and residue of my worldly estate and succession, real & personal, after the payment and satisfaction of my said debts and particular legacies, I give, devise and bequeath the whole unto Samuel Rollins Jr. my only son, born of my said marriage, also farmer of the said Township of Shefford, to have & to hold, to use, enjoy and dispose, under the restrictions, provisos and reserves hereinafter made and mentioned, of my said property and estate or residue thereof, unto my said son, Samuel Rollins, his heirs and assigns, as his own and proper freehold forever by virtue hereof, and to enter upon and take possession of my said property and Estate, on the day and hour of my said decease, hereby instituting the said Samuel Rollins my said son my sole, general and residuary Legatee.

It is my express wishes and intentions, and I will order and require that my said son and general legatee shall have no right to dispose by will or donation of my said Estate and succession so willed to him by these presents in favor of his present wife nor any other wife or wives or persons, other than his own children lawfully begotten, and should he depart this life, without lawful issue or issues of his present marriage or any subsequent marriage, or having left issue or issues and the latter departing this life before he or they attain the age of one and twenty, in such cases the property to him willed by these presents shall revert and belong to his said three sisters or their representatives, as if the same were willed & bequeathed to them directly, at the charge however of paying Dame Betsey or Elizabeth Craig, the actual wife of the said Samuel Rollins my said son, providing she survives him and in that case only, the sum of two hundred & fifty dollars, making with a like sum provided for by my said husband the sum of five hundred dollars, to be in lieu of all I have & portions, rights, claims & demands, that she may or might have and pretend upon the property real & personal, willed by these presents to my said son, such is my express wishes and intentions as regard the property which I have presently willed to my said son, these restrictions however shall not be deemed to be a bar to the right and privilege of my said son and general legatee of disposing of my said Estate to apply the provisos on some other property, as he may see fit and proper, my sole object being to keep and retain my said Estate & succession or the residue thereof, in the hands of my said children and their own children in their default.

And for executing this, my present will and testament, I do hereby name and appoint for my testamentary executor, and as guardian over my said property and Estate, in case a guardian should be required, the said James Blampin my son-in-law, also farmer of the Township of Roxton, in the hands of whom I do hereby divest myself of all my said property to be disposed of the same as I have just ordered.

I do hereby revoke all other wills, testaments or codicils which I may have made before this present which above contains my express wishes and intentions.

Thus this was done, made and executed at the said village of Waterloo, in the office of Thomas Brassard, the said undersigned Notary, on the day, month & year first above written, under the number five thousand and thirty of the minutes of the said Notary.

And this said present will having been duly read over, by the said Notary, presence of the said witnesses, to the said testatrix, she declared that she understood and comprehended the same will and found this testament in every respect conformable to her last wishes and intentions and emphatically declared the same to be her last will and testament.

In faith and testimony whereof, the said Testatrix, with us the said Notary and witnesses has set and subscribed her name, to these presents, her said last will and testament, just duly read over as above said.

Five erased words are null & void. Two marginal notes are good.
