Sain family of Early Fairfield County Ohio [14 November 2011]

Two Brothers Peter and Phillip Sain moved to Fairfield County Ohio about 1802 from Frederick County, Virginia. All the Sains in this area in the early 1800's are descended from these two brothers. Their father Phillip Sain Sr born about 1730 in Germany moved to Frederick County, Maryland. He is on the 1790 Census there.

This is his will: Will Of Philip Sain Senior (See Sain file p. 390)

I Philip Sain Senior of Fredrick County and state of Maryland being of sound and disposing mind memory and understanding do make publish pronounce and declare this to be my last will and testament in manner following that is to say Imprimis It is my will and desire that my just debts and funeral expenses be paid as soon as maybe after my decease Item: I give and bequeath into my executors here to forenamed the one fourth part of all real and personal Estate to hold the same in trust for and to the use of my daughter Elisabeth Pipple during her natural life and in case any part of the same should remain unexpended for the use of and at the decease of my said daughter that then such or surplus shall be divided among the children of my said daughter their heirs and assigns share and share alike Item: I give and bequeath unto my son Philip one other fourth part of my estate real and personal and to his heirs and assigns forever. Item: I give and bequeath into my daughter Christina one other fourth part of my estate real and personal and to her heirs and assigns forever Item: I give and bequeath unto my son Peter the remaining one fourth part of my estate real and personal and to his heirs and assigns forever. Lastly I do and nominate and appoint my said son Philip and my son in Law John Coonce (Loonce) to be executer of this my last will and testament hereby revoking all former wills by me made allowing and confirming this and none other to be my last will and testament In witness whereof I have here to set my hand and seal the 10th day of October in the year of our Lord one thousand seven hundred and ninety eight Signed sealed published pronounced and declared by Philip Sain Senior the testator as and for his last will and testament in his presence and in the presence of each other hand Subscriber our names as witnesses thereto Zrefort Homz M firmort Gorltznst Lacvier and Solomon Kemp Fredrick County November 2, 1799. Then came Philip Sain and John Loonce and made oath on the holy Evangels of Almighty God that the forgoing instrument of writing is the find and whole will and testament of Philip Sain late of Fredrick County deceased that hath come to their hands and possession and that they know of no other George Murdock Register Fredrick County November 2, 1799. Then came Peter Kemp one of the subscribing witnesses to the forgoing last will and testament of Philip Sain late of Fredrick County Deceased and solemnly affirm and declared that he did see the tester therein named sign and sealed this will at the same time Balsor Kramer Kramer one other of the subscribing witness to the forgoing last will and testament of Philip Sain also made oath on the Holy Evangels of Almighty God that he did see the testator there in named sign and seal this will that they heard him publish pronounced and declare the same to be his last will and testament that at the time of his so doing he was to the best of their apprehensions of sound and disposing mind memory and understanding that they respectively subscribed their names as witness to this will in the presences and at the request of the testator and that they did also see Solomon Kemp the other subscribing witness sign his name as a witness to said will in the [presence and at request of the testator and all in the presence of each other. Will of Phillip Sain Jr Will dated 1816 in Rushville, Fairfield County, Ohio does not name his children except for son Jacob Sain as Executor with Wife Barbary Sane.
